Suit has been brought by the Kim
ball Steamship Company of San Fran
Cisco against the Honolulu Market Co.,
for (9S.013.49, Interest ami attorncs
fees. Tbe complaint ffts forth a con
tract between the Honolulu Market
Company and the steamship company
In which the former agreed to use 150
tons of refrigerator space, to be sup
plied by said steamship company. This
space was taken for a period of two
)ears and was to be pajd for at the rate
of $10 per ton measurement. It was
further agreed that the Kimball Steam
ship Company upon three months' no
tice from the Market people, should
put on an additional steamship.
It Is alleged in the complaint that
in pursuance of the terms of the con
tract, the plaintiff has been ready to
carry out the agreement, and that a
steamship has been supplied ami two
oyages made. It alleges that the de
fendant company has refused, since
February 13, 1901. to use the refrigera
tor space upon the steamship, supplied
by plaintiff and on March 2S. 1901, no
tified tho plaintiff that It would make
no further shipments under the con
tract. In consequence of thts refusal, the
plaintiff claims to hare been damaged
In the sum ot $00,000.
As further damage, the sitm of $21,
187. spent by plaintiff for special equip
ment of refrigerator space, useless
since the breach of contract. Is added
to the judgment asked. Also $8000,
which plaintiff claims It could ha
earned In the Alaska trade, while mak
ing tho voyages to Honolulu. The com
plaint claims the defendant company Is
Indebted to the plaintiff for past ser
vices In the amount of r.'2, 413.30.
The suit Is brought by John 11. Mul
lock, secretary for the Kimball Steata
