Chief .Justice Frear of the Hawaiian
Supreme Court has been sued by At
torney Gcorgo A. Uavli for 130,000
damages, for wrongs alleged to hao
been committed upon plalutlft In open
court. The summons was served upon
the Chief Justice yesterday aftcrnon
by United States Marshal D. A. Ray.
The suit Is upon tort and Is brought Id
the United States District Court.
The cause of the complaint Is speci
fied by Mr. Davis, was that on July
C, Chief Justice Frear nssaulted and
beat plaintiff nml gave him Into tha
custody of the deputy sheriff of tho;
Territory of Hnwall and falsely and
without Jurisdiction Imprisoned tho
said plaintiff and with force and arms
ejected and removed him out of the
courtroom of the Supremo Court. Tho
complaint also alleges that the Chief
Justice caused the plaintiff to be Im
prisoned for a long time without Juris
diction, authority or Justification by
law nml without due process of law anil
In violation of plaintiff's rights under
the Constitution of tho United States
of America. The Imprisonment Is de
clared to be "unlawful and malicious"
and said Walter F. Frcar "well knew
that he had no Jurisdiction to so ns
fault, beat, arrest and imprison tho
The complaint states that at the time
the grievances wero commlttecd tho
plaintiff was lawfully engaged In prac-J
tiring his profession and was regularly
arguing a motion before the Supreme
Court. Mr, Davis alleges that he was
endeavoring to bavc the case of Haney

Court calendar. It Is pointed out that

the plaintiff was lawfully endeavoring

tiff alleges that he was presenting tho

manner, and that when ho requested
the Chief Justice to fix a date, the Chief
.Justice arbitrarily and maliciously or
dered and commanded the sal.1 plaintiff
to "sit down" which order and com
mand was obeyed by the plaintiff, after
which he arose and addressed the court
respectfully, whereupon the said Wal
ter F. Frcar committed the grievance
herein set forth lu this complaint.
Ily reason of the alleged wrongful,
unlawful and malicious nets of the said
defendant, plaintiff clnlms he suffered
meat pain of body nnd mind and was
humiliated nnd Injured In his profes
sion, calling, credit nnd circumstances
nnd was hindered and obstructed In
carrying on his profession and business
In which he was lawfully engaged.
Plaintiff therefore asks damages In
