Treasury Department July 2G. 1901.
Sir: The Department Is In receipt ot
your letter of tho 25th Inst., Inclosing
a communication received by jour
company from the Nltro Powder Com
pany of Kingston, N. V., In reference
to projected shipments of nltro pow
ders to Cuba and Mexico the Nltro
Powder Company dcslrca to ship, but
which your company has refused to
accept on the ground that nltro pow
ders would probably come "under the
head of articles prohibited by law to
be carried on passenger steamers." and
j on nsk for n ruling of the Department
on the subject.
In reply, j-ou are Informed that not
withstanding tho claims of the Nltro
Powder Company that their nltro pow
der Is safer than ordlnury black pow
der, though used for blasting purposes
"In competition with dynamite." the
Department can only class It with
other "like dangerous articles' 'referred
(o In section 472, Revised Statutes,
unit that It lias no ffuthorlty to permit
Us enrriage on such passenger steam
essels, as the only explosive powder
named In the law (Sec. 4422. Rev. Stat.)
that may be carried on cuch passenger
stelimcrs Is the ponder designated In
the section referred to as "gunpowder."
In mnklng this decision, the Depart
ment has no Intention of contesting the
claim of the Nllro Powder Company as
to the safety ot the nltro powiler manu
factured by them as compared with
gunpowder. Its decision being based
wholly on the technicality of the law ns
to the kind ot cxptosUc powder thai
may legally be carried on passenger
steamers.

The band concert at tho Hawaiian

ture was the rendition of four new

Alapal. The songs were composed by
Mrs. Kmma do Krles and urranged by
Captain Ilergcr. Tho titles of the new
compositions arc "Kttkllnklla," "Wnl
Kaahuula," "Klllolanl" and "Llhollho."
Uurlng tho concert, Mrs. de Pries
entertained a number of guests on tho
hotel lanals. Tho large crowd In tho
park applauded the new songs with
marked appreciation.
