of the Forakcr Act,
Tho Solicitor holds advctsely to Mr,
de Uetnu's contention, and in the
course of his opinion sujs: "It Is evi
dent from the care with which coffee
was excluded In the Foraker Act from
the free list. In respect to Importations
from the United States during the
existence of the IS per cent duty sjs-
'.era, that it was the intention of Con
grcss to -ecognlie and protect the cof
fee industry In Porto Rico. It can
hardly be doubted, also, that it was not
the purpose uf Congress that such pro
tcctlon shuttld cease uon the enact
ment and Installation of u lo-nl s.vs
ten of taxation In Porto Itlco. The
duty of S cents per pound on coffee was
I think, distinctly a protectee mens
tire. Hut I regret to siy thnt I see no
escape from the conclusion that the
bioad nud uuicatrlcted provision uf
section ', abolishing "all tariff duties
on merchandise nnd articles going Into
Porto Itlto from the United States'
upon the enactment of a local sjstem
of fnxntlon. etc.. embraces thf duty on
coffee ns well aa the dut on any other
article of merchandise. The case seems
to me to be one of mere Inudvcrtence
on the part of Congress. They merely
neglected to mnko the exception of
coffee from the free list applicable as
well after the adaption ot the new
tern of taxation ns during the exist,
erne of the IS per centum duty sjs
