WHEREAS an order was duly made
In the above entitled matter by the
Honorablo A. S. Humphreys, First
Judgo of the Circuit Court of tho First
Circuit, on the 17th day of March,
1902, authorizing tho undersigned, F.
Wundcnberg, Receiver pf tho Kona
Sugar Company, Limited, to sell cer
tain property therein specifically de
WHEREAS It Ib therein ordered
that tho entire property and estate of
the said Kona Sugar Company, Limit
ed, be sold by said Receiver, that la to
say, all Its lands, tenements and here
ditaments, all Interests In lands, leases
and leasehold Interests, rights of way,
railroads, sugar mill, machinery, build
ings, lumber and materials, tools and
Implements, engines, cars and all kinds
of rolling stock, Including wagons and
vehicles of all kinds, crops, harness,
live stock, agreements, contracts, and
nil franchises and rights of said Com
pany, and the good-will of said Com
pany, and all other property of said
Company now owned or hereafter to
be acquired by virtue and under au
thority thereof, exclusive of choscs in
WHEREAS said Ilccclver Is author
ized to sell said property for cash, and
WHEREAS It Is further ordered that
notice of tho tlmo and place of sale
shall be given by said Receiver by ad
vertising tho same for twenty (20)
days In the Dally Evening Bulletin, n
newspaper published in Honolulu, and
tho Weekly Hllo Tribune, a newspaper
published ln Hllo, Hawaii, and that
such sale shall be had at such time
and place as said Receiver shall In
such notices of Rale appoint, and
WHEREAS It Ib further ordered
that said Receiver may require before
accepting any bid that the person or
nersons making tho same shall doposlt
fivo per cent (6) of the amount of
such bid, and In case said property
nnd premises nro sold, the purchaser
or purchasers shall forthwith deposit
with said Receiver an additional five
per cent, amounting In nil to ten per
cent (10) oi tho amount oi ins pur
chase, and at the time and place fixed
for tho confirmation of the sale, and
after tho same shall have been con
firmed by tho Court, the purchaser
purchasers of said property shall pay
tho amount remaining unpaid of his or
their respective bids to the Receiver
In Gold Coin of the United States of
Amerlui, or ho or' they may give a
bond for that nmount to the said Re
ceiver with two or more sureties to bo;
approved by tho Court, conditioned
that ho or they will up to that amount
pay such persons as the Court Bhall
direct such sums as may in such order
be directed to bo paid, and In such
manner and upon such terms as may
be described therein, and that there
upon such purchaser or purchasers
shall bo entitled to receive possession
I of tho said property so purchased by
J him or them. For more particularity
.as to the terms of sale, reference Is
f hereby made to said decree.

Receiver aforesaid. In pursuance of the
