WHEREAS an order was duly made
In tho abovo entitled matter by the
Honorablo A. S. Humphreys, First
Judgo of tho Circuit Court of the First
Circuit, on tho 17th day of March,
1983, authorizing tho undersigned, F.
Wundcnbcrg, Receiver of tho Kona
Sugar Company, Limited, to sell cer
tain property therein specifically de
WHEREAS It Is therein ordered
that tho cntlro property and estato of
the said Kona Sugar Company, Limit
ed, be sold by said Receiver, that is to
say, all Its lands, tenements and here
ditaments, all Interests In lands, leases
and leasehold Interests, rights of way,
railroads, sugar mill, machinery, build
ings, lumber and materials, tools and
Implements, engines, cars and all kinds
of rolling stock, Including wagons and
vehicles of all kinds, crops, harness,
live stock, agreements, contracts, and
alt franchises and rights of said Com
pany, and the good-will of said Com
pany, and all other property of said
Company now owned or hereafter to
bo acquired by vlrtuo and under au
thority thereof, exclusive of choses In
WHEREAS said Receiver Is author
ized to sell said property for cash, and
TVHEREA8 It Is further ordered that
notice of tho time and place ef sale
shall be given by said Receiver by ad
vertising tho same for twenty (20)
Hays In the Dally Evening Bulletin, a
newspaper published In Honolulu, and
tho Weekly Illlo Tribune, a newspaper
published In Hllp, Hawaii, and that
such sale shall be had at such time
and1 place as sai'd Receiver shall In
suck notices of sale appoint, and
WHEREA8 It Is further ordered
that said Receiver may require before
accepting any bid that the person or
ereons making the same shall deposit
five per cent (6) of the amount of
such bid, and In case said 'property
and premises are sold, the purchaser
r purchasers shall forthwith deposit
with said Receiver an additional five
per cent, amounting In all to ten per
cent (10) oi tho amount of his pur
chase, and at tho time and place fixed
for tho confirmation of the sale, and
after the same shall have been con
firmed by the Court, the purchaser or
purchasers of said property shall pay
tho amount remaining unpaid of his or
their respective bids to the Receiver
In Gold Coin of the United States of
America, or he or they may glvo a
bond for that amount to the said Re
ceiver with two or more sureties 'o bo
approved by the Court, conditioned
that he or they will up to that amount
pay such persons as the Court shall
direct such sums as may In such order
be directed to be paid, and In such
manner and upon such terms as may
he described therein, and that there
upon such purchaser or purchasers
shall be entitled to receive possession
at the said property bo purchased by
him or them. For more particularity
as to the terms of sale, reference is
hereby made to said decree.
NOW THEREFORE public notice Is
heicby given that I, F. Wundenberg,
Receiver aforesaid, In pursuance of the
provisions of said decree, will, on Sat
urday, the 12th day of April, A. D.
1902, at the hour of 12 o'clock noon,
