WHEREAS an order was duly made
In the abovo entitled matter by the
Honorablo A. S. Humphreys, First
Jitdgo of the Circuit Court of the First
Circuit, on tho 17th day of March,
1902, authorizing tho undersigned, F,
Wundonberg, Receiver of the Kona
Sugar Company, Limited, to sell cer
tain property therein specifically de
WHEREAS It Is therein ordered
that tho entire property and estate of
the said Kona Sugar Company, Limit
ed, be sold by said Receiver, that Is to
Bay, all Its lands, tenements and here
ditaments, all Interests In lands, leases
nnd leasehold Interests, rights of ay,
railroads, sugar mill, machinery, build
, Ings, lumber and materials, tools and
Implements, engines, cars and all kinds
of rolling stock, Including wagons and
vehicles of nil kinds, crops, harness,
live stock, agreements, contracts, and
all franchises and rights of said Com
pany, and the good-will of said Com
pany, and all other property of said
i Company now owned or hereafter tn
be acquired by virtue and under au
thority thereof, exclusive ot choses In
WHEREAS said Receiver Is author
ized to sell said property for cash, and
WHEREAS it Is further ordered that
notlco ot the time and place ef sale
shall bo git en by said Receiver by ad
vertising tho same for twenty (20)
days In the Dally Evening Bulletin, n
newspaper published In Honolulu, and
the Weekly Hllo Tribune, n newspaper
published In Hllo, Hawaii, and that
such salo shall be had at such time
and place as said Receiver shall In
such notices of Bale appoint, and
WHEREAS It Is further ordered
that said Receiver may require before
accepting any bid that the person or
persons making the same shall deposit
live per cent (5) of the amount ot
such bid, and In rase said property
and picmlses are sold, the purchaser
r purchasers shall forthwith deposit
with said Receiver an additional flvo
per cent, amounting In all to ten per
cent (10) oi the amount of his pur
chase, and at the time nnd place fixed
for the confirmation of the sale, and
after the same shall have been con
firmed by tho Court, the purchaser or
purchasers of said property shall pay
the, amount remaining unpaid ot his or
their respective bids to the Receiver
In Gold Coin ot the United States of
America, or he or they may glvo a
bond for that amount to the said Re'
eelver with two or more sureties o be
unproved by the Court, conditioned
that he or they wilt up to that amount
pay such persons as the Court shall
direct such sums as may in such order
be directed to be paid, and In such
manner and upon such terms as may
he described therein, nnd that there
upon such purchaser or purchasers
shall bo entitled to receive possession
f the said property so purchased by
him or them. For more particularity
as to the terms of sale, reference Is
hereby made to said decree.

Receiver aforesaid, In pursuance of the
provisTons of said decree, will, on Sat
