WHEREAS an order was duly made
in the abovo entitled matter by tho
Honorablo A. 8. Humphreys, First
Judgo ot tho Circuit Court of the First
Circuit, on tho 17th day of .March,
1902, authorizing tho undersigned, F.
Wundcnbcrg, Receiver of the Kona
Sugar Company, Limited, to sell cer
tain property therein specifically de
WHEREAS It Is therein ordered
that tho cnttro property and estate of
tho said Kona Bugar Company, Limit
ed, be sold by Bald Receiver, that Is to
say, all Its lands, tenements and here
ditaments, all Interests in lands, leases
and leasehold interests, rights of way,
railroads, sugar mill, machinery, build
ings, lumber and materials, tools and
Implements, engines, cars and all kinds
of foiling stock, Including wagons and
vehicles of all kinds, crops, harness,
live stock, agreements,, contracts, and
all franchises and rights of said Com
pany, and the good-will of said Com
pany, and all other property of said
Company now owned or hereafter to
be acquired by virtue and under au
thorlty thereof, exclusive ot cboses In
WHEREAS said Receiver is author
Izcd to sell said property for cash, and
WHEREAS It Is further ordered that
notice ot the time and place of sale
shall bo given by said Receiver by ad
vertising tho samo for twenty (20)
days In tho Dally Evening llullctln, a
newspaper published In Honolulu, and
the Weekly Hllo Tribune, n newspaper
published In Hllo, Hawaii, and that
such, sale Bhall be had at such time
and place as said Receiver Bhall In
such notices ot sale appoint, and
WHEREAS It Is further ordered
that said Receiver may require before
accepting any bid that the person or
persons making the same shall deposit
Ave per cent (5) of the amount of
such bid, and In caso said property
and premises arc sold, the purchaser
r purchasers shall forthwith deposit
with said Receiver an additional five
per cent, amounting In all to trn per
cent (10) oi the amount of his pur
chase, and at the time and place fixed
fer tho confirmation ot tho sale, and
after tho samo shall have been con
firmed by the Court, tho purchaser or
purchasers of said property shall pay
the umcftint remaining unpaid of his or
their respective bids to the Receiver

America, or ho or they may give a
bond for that amount to the said Re
ceiver with two or more sureties 'o be
approved by the Court, conditioned
that he or they will up to that amount
pay such persons as the Court Fhall

bo described therein, and that there
upon such purchaser or purchasers
shall e entitled to receive possession

provisions of Bald decree, will, on Sat

1902, at tho hour of 12 o'clock noon,

Hale), in Honolulu, Island of Oahu,
Territory of Hawaii, sell at public auc
tion to tho highest bidder In accord
once with the terms and conditions of

discharged from all mortgages, liens
and charges of every kind and descrlp
