Honorablo A. S. Humphreys, First
Judge of tho Circuit Court of the First
Circuit, on tho 17th day of March,
1902, authorizing the undersigned, F.
Wundcnbcrg, Receiver of the Kona
Sugar Company, Limited, to sell cer
tain property therein specifically do
scribed, and
WHEREAS It Is therein ordered
that tho cntlro property and cstato of
the said Kona Sugar Company, Limit
ed, be Bold by said Receiver, that Is to
say, all its lands, tenements and here
ditaments, nil Interests In lands, leases
and leasehold Interests, rights of way,
railroads, sugar mill, machinery, build
ings, lumber and materials, tools and
Implements, engines, cars and all kinds
of rolling Btoclc, including wagons and
vehicles of all kinds, crops, harness,
live stock, agreements, contracts, and
all franchises and rights of said Com
pany, nnd tho good-will of said Com
paiy, and all other property of said
Company now owned or hereafter to
bo acquired by virtue and under au
thority thereof, exclusive of choscs in
action, and
WHEREAS said Receiver Is author
ized to sell said property for cash, and
WHEREAS It Is further ordered that
potlco of the tlmo and place of sale
shall bo given by said Receiver by ad
vertising tho samo for twenty (20)
days In the Dally Evening Bulletin, a
newspaper published In Honolulu, and
the Weekly Hllo Tribune, a newspaper
published In Hllo, Hawaii, and that
such sale shall be had at such time
and placo as said Receiver shall In
such notices of sale appoint, and
WHEREAS It is further ordered
that said Receiver may require before
accepting any bid that the person or
persons making tho same shall deposit
Ho per cent (5) of the amount of
such bid, and In case said property
and premises are sold, tho purchaser
or purchasers shall forthwith deposit
with said Receiver an additional Ave
per cent, amounting In all to ten per
cent (10) oi the amount of his pur
chase, and at the tlmo and place fixed
for tho confirmation of tho sale, and
after tho same shall have been con
firmed by the Court, the purchaser or
purchasers of said property shall pay
the amount remaining unpaid of his or
'their respective bids to tho Receiver
In Gold Coin of the United States of
America, or he or they may gtvo a
bond for that amount to the said Re
ceiver with two or more sureties o be
approved by tho Court, conditioned
that ho or they will up to that amount
pay such persons as tho Court (hall
direct such sums as may In such order
be directed to be paid, and In such
manner nnd upon such terms as may
bo inscribed therein, and that there
upon such purchaser or purchasers
