TOOK FEDERAL ATTORNEY
BRECKONS FOR INTRUDER
Hearing of Libel Against Schooner
Frank W. Howe Begun Before
Commissioner Qill Second
Commissioner 0111 began tho preli
minary hearing of the admiralty libel
against tho schooner Frank W. Howe
Win, McCalllster, the second mate,
testified regarding the amount ot pro
visions taken on board and said that
after the Howe left Mauritius the sup
ply ran short. Tho men lived wholly
upon soup, rice and curry, baked beans
and salt beef. The potatoes. gave out
within a couple ot weeks alter leaving
port, and the beef was so salty that
the men refused to eat It, and they
threw Ihelr food overboard. He testi
fied that they got all tho vinegar they
wanted and drank rainwater because,
they thought It as good as any. Woods
and Hall became sick and were unable
to work. The men In the forecastle,
he said, generally got tho leavings
from the cabin, and tho bread was
sometimes three or four days old. The
steward was most to blame, according
to tho mate, though tho provisions
wero not as good as he had been used
On cross examination tho witness
testified That there had been no dis
crimination between the cabin and the
forecastle, and that the same kind ot
salt beef was served to all alike. The
seamen always had plenty and there
was no complaint about tho soup. In
fact, tho trouble appeared to be over
the cooking, and the witness said that
ho had a disagreement with the cook at
the beginning ot tho voyage.
An amusing Incident occurred at the
beginning ot the hearing. Mr. Kinney
had never beforo met the United States
attorney, and seeing him beside As
sistant U. S. Attorney Dunno thought
htm a witness. He was saved from
making a motion for the expulsion ot
the Federal attorney by an Introduc
tlon to Mr. Drcckons from Mr. Dunne.
