GEAR CONDEMNS NEW LIQUOR LAW

grounds that It states no offense and
tho law Is unconstitutional. It pro
vides that no person can 'dispone' of
any jlquor without having a license.

Judgo Do Holt overruled the demur
icr. Judgo dear stated later on that
tho law could Do proved unconstitu
tional on n dozen points.
Trior to bringing up this point,
Judgo Clear, who represented tho de
fendant, and Deputy Attorney Oencrul
I'rosscr, who conducted tho caso of
tho prosecution, clashed In another
phase of the case. It was found that
while nollto of tho defendant's np
pcal and cortllkntu of appeal had been
cut from the District Court up to
tho Circuit Court, no trnnscrlpt of cvl
dunce or the complaint had been sent

and signed a charge against tho de
fendant, but Clear contended that this
could not bo done, and that the caso
could not proceed without tho com
plete record.
Clerk Ilenjamln Zablan of tho Dis
trict Court was called. Ho explained
that through a misunderstanding his
assistant had neglected to send up the
complnlut nnil transcript of evidence.
Judgo Do Holt stated that ho wished
it understood that ho did not approvo
of this way of sending up an appeal
without a record; ho merely consider
ed It helpful but not necessary.
Tho work of drawing a jury was
then proceeded with. Among tho
