Suction 1. Subdivision i" of Section (iiJ of Chapter 14 of
Act .'III of the Session Laws of 1!I0.", is hereby amended to read
"r. To Regulate and Presenile by Ordinance within tho
limits of the County all local police, sanitary and oilier regu
lations not in eonllict with the general laws of the Territory,
or the rules and regulations of the Territorial Hoard of Health,
anil to fix a penalty for tho violation thereof, which said pen
alty mny be by fine not to exceed $500.00, together with tho
costs of eourt, and in the event of default of payment of such
fine or costs of eourt that the offender shall bo imprisoned until
such fine or costs shall have Ik-cii discharged by operation of
tho general law in such eases."
SiK'Tiox 2. This Act shall take effect from and after the
date of its approval.

Unacted by the Legislature of the Territory of Hawaii:
Skction 1. The Treasurer of each County with tho ap
proval of the Hoard of Supervisors of such County, is hereby
authorized and empowered to issue from time to tinio bonds of
such County, with interest coupons attached thereto, the prin
cipal and interest' to lie payable in Gold Coin of the United
Slates of America, or its equivalent nt its present standard of
weight and fineness, in the. manner, upon the terms, mid for
the purpoc in this Act stated, but the total of such indebted
ness which may lx incurred by any County shall not exceed
three per centum of the assessed value of the taxable property
ill such County nor shall the amount of such indebtedness
which may bo incurred in any one calendar year exceed ono
per centum of such assessed value.
Suction 2. Such bonds shall bo issued only for the purposo
of meeting tho requirements of the County for tho erection
of penal, charitable and educational institutions, and for public
buildings, wharves, roads and harbor and other public improve
ments. Suction :. Xo bonds shall ho issued until a resolution au
thorizing the issue thereof, hcttiug forth the amount, rate of
interest mid tho term of tho proposed bond isuo, with a de
tailed statement of tho uses to which it is proposed to put tho
proceeds of such kinds, shall have been passed by the Supervi
sors of the County and confirmed by an Acl of tho Legislature
approving and permitting such proposed issue or such amount
thereof as tho Legislature shall deem advisable; nor shall any
such issue of bonds bo made until approved by tho President of
the I'nited States.
Skl'tio.v 4. All bonds issued under the authority of this Act
'shall bear interest, payable semi-annually, at a rate of not
more than five per cent per annum, and be made redeemable
in not more than five years, and payabl in not more than fifteen
years from- tho date of issue tliercof or in such other time or
times respectively as may bo hereafter authorized by law.
Suction .1. All such lxmds anil interest coupons shall bo
exempt from any and all taxes whatsoever, and tluf payment
of the principal and interest shall constitute a charge upon the
consolidated revenue of tho County issuing them.
Suction (I. The proceeds of all bonds issued under the
authority of this Act Bhall Imj devoted exclusively to tho pur-po-ica
for which tho same are issued, as expressed in tho Reso
lution of tho Board of Supervisors and tho approving Act of
Sm-iion 7. The Tieasuier of Ihe Coiiuly, with Ihe approval
of tho Chairman of tho Hoard of Supervisor, shall determine
the denomination of lionds issued under the authority of this
Act and of tho approving Act of the legislature,' and the plnco
or places where the principal nnd interest of such bonds, or
any of them, shall bo payable, audthe method of their redemp
tion. Said Treasurer shall niako such arrangements as may bo
necessary or proper for the sale of the whole or any part of each
authorized issue. Such arrangements shall provide for the salo
of such bonds by the County itself, either by private sale or by
' public advertisement for tenders at least onco each week for
not less than nino weeks, in n newspaper of general circulation,
published in Honolulu, and in a newspaper, if any, of general
circulation published in the County, but no bond shall lie sold
at less than two per cent, below its nominal par value; provided
that licforc any sole is made the Treasurer shall first secure tho
approval of such sale by the Hoard of Supervisors.
Suction 8. AJ1 lsmds issued under tho provisions of this
Act shall Iks lithographed or steel engraved, and shall bo signed
by the County Treasurer and tho Chairman of tho Roard of
Supervisors, and bo sealed with the seal of tho County. Inter
est coupons may bear a lithographed or engraved fac-similo of
the signature of tho County Treasurer.
Suction II. Tho Treasurer of the County shall pay the prin
cipal of such lionds at maturity, and the interest thereon as tho
same Incomes duo at the place or places and in the manner pro
scrilied for such payment under tho provisions of this Act.
Suction 10. In ease of any default in the payment of tho
principal of any such bonds nt maturity or of tho interest
thereon when the same shall become due, the holder of any of
tho lionds on which any such default is made may bring nu
action at law against the County making such default, for tho
amount due by reason of such default, and should any moneys
bo" then or thereafter payable by tho Territory of Hawaii to.
the County defendant in such action he may in the petition and
prayer for process insert a request to the court or magistrate
issuing process to insert therein a direction to the ollieer serv
ing the same to leave a true copy thereof, attested by the High
Sheriff, or his Deputy, or the Sheriff of Iho County or his
Deputy, with the Auditor of tho Territory, who hereafter in
this Act is called the garnishee.
Suction 1 1. Service of such process ujiou the garnisheo may
lie made as follows: if the garuMico lives or has his oflieo in
the district where such process is issued, by handing such copy
to him personally, or leaving it in his ollieo with a deputy, elerk
or other employee therein; if the garnishee does not live, nor
have an ofliee in the district where such process is issued, by
handing such copy to him personally, or by depositing it. in the
nearest post ofliee, enclosed in a sealed envelope, postage pro
paid, and addrcsxcd to the garnishee at his ofliee in Honolulu.
Suction 12. It shall not be incumbent on the garnishee to
apMar and answer such process but the trial Jf such action -shall
proceed in nil respeets as if the garnishee had not been
made a party. Hut from the time of service upon him, it shall
lie unlawful for such garnishee to draw, sign or issue any war
rant payable to the order of tho County defendant or nny of
its oflieers or permit or cause tho sanio to lio done, for any
moneys which may Iki then or thereafter payable to sueh de
fendant until the action shall havu liccu finally determined and
the judgment therein rendered, if nny, shall havo liccn fully
paid and satisfied with legal interest thereon; but all moneys
due or to become duo to such defendant shall bo held in tho
Treasury of the Territory from the time of such service until
sueh final judgment or determination of sueh action; provided,
however, that no more shall thus lie held than shall be sufficient
to meet the demand with costs and interest of plaintiff or plain
tiffs in sueh action. I
Suction ID. After final judgment or determination of nny
such notion tho party .prevailing shall obtain from tho Court
by which such final judgment or determination was made a
certificate, which shall sufficiently descrilx' the action to apprise
tlio garnishee of its identity, and shall stato tho nature of tho
final judgment or determination made therein, and sueh certifi
cate shall lie immediately furnished to the garnishee.
Suction 14. If final judgment is rendered against defend
ant in any such action such garnisheo shall immediately there
after draw, sign and deliver to tho plaintiff or plaintiffs a war
rant or warrants for the sum held by him in oliedieucc to such
service of process; and if such sum shall not equal tho amount
of such final judgment, then tho drawing, signing and delivery
of such warrants shall continue to bo made from time to time
until such final judgment with interest shall be fully paid.
All warrants so drawn, signed and delivered shall lie charged
against tho defendant.
Suction 1.1. In caso of successive actions being so brought
against tho sumo County defendant, precedence shall lo given
by the garnishee to that in which process is first served on him;
and if two or more sueh processes aro simultaneously served,
precedence shall bo given in tho order of tho priority of therr
issue by tho courts or magistrates respectively issuing them.
This order of precedence shall not bo disturbed by tho fact of
a posterior suit being carried to final judgment earlier than its
anterior in time of service on tho garnishee, hut in sueh case
the garnisheo shall draw, sign and deliver warrants on account
of such earlier judgment for only such sums as shall lio payable
upon sueh judgment from the amounts which shall thereafter
become duo and payable to such defendant. All amounts held
on account of sueh anterior suit shall bo. held until tho final'
judgment or delenuimition thereof, and then applied in pay
ment thereof. In caso sucji amounts hIiiiII not be sufficient to
fully satisfy sueh judgment, then all judgments obtained in
posterior suits shall be again postponed to that in the anterior
suit until it is satisfied.
Suction 10. Tho power and nuthority given in (his Act
to the several Counties to issue bonds shall not bo held in any
manner to authorize and empower the Counties or any one
of them to levy and impose taxes. Rut should any county
hereafter be authorized and empowered by law to raise revenuo
by the levy and imposition of taxes, and make default, in tho
payment of any judgment secured against said county, upon
an action at law for tho collection of tho principal or interest
or any part of either thereof, of any liond of said county, tho
Treasurer of such county shall thereafter reserve from tho
consolidated levenues of said county, as soon ns received, money
sufficient to pay such judgment.
Suction 17. This Act shall take effect from the date of its
