The famoui old Lticwclko claim
which caused a row between the last
Legislature and Oovernor Carter, and
which later on went through tho
courts, is again n cnuso of trouble.

Savldge, as administrator ot the Luc
wclko estate, and Land Commissioner
Pratt and Auditor Flsher'for tuo pur
pose ot collecting nn attorney's feo
for services rendered in connection
with tho claim,
Lucwclko's claim originated when
the Territory condemned some ot his
land at Molltlll In order to present
the Rapid Transit Co. with a right of
way. This claim was Included In n
bll before tho Inst Legislature. This
bill passed. Carter vetoed It, but tho
oto was overridden. This did not
end the trouble, however, for Land
Commissioner Pratt refused to np
provo of tho claim, nnd n mandamus
proceeding hud to ho brought, which
finally wound up in the Supremo
Court, which sustained tho decision
rendered by the Circuit Court com
pelling Pratt to approve of the claim.
Now the Government Is ready to pay
tho claim, but Savldge Is not collect
ing Just nt present, ns he fears that
tho estate may bo Insolvent, In which
cnee ho wnntB Harrison to take his
pro rntiwif the feo together with thu
ctucr creditors, Instead ot getting his
tdinre in full.
Harrison In his complaint tells tho
long story of tho vicissitudes of tho
Lucwelko claim, and shows that ho
was retained ns nu attorney by Luc
welko with the agieemcnt that ho
Biiould get n fee ot $450 when thn
claim was plnd. Later on, Lucwelko
borrowed $5 from him and this, to
gether with S21 of disbursements,
hi lugs the Harrison claim up to S480.
Harrison states further1 thnt ho la
Informed that tho Land Commission
er will now npprovo ot a receipt lu
full for tho Si 500, mid Hint Auditor
Fisher will Issue warrants for that
amount. He fears, however, that
the Lucwelko estato may not bo solv
ent, nnd that Snvldgo may refuse to
acknowledge his lien tor $480, ns ho
threatens to convert tho whole ot tho
11500 to the uses ot tho estate.
Harrison prays thnt Savldge ba or
dered to present for approval to tho
Land Commissioner n receipt in full
for the S1G00, nnd that tho Auditor
issue warrants for tho payment ot tho
Harrison claim. He nlso prays that
temporary Injunctions Issue ngaluxt
the Auditor to prevent him from 'pay
ing the $480 to Savldge, and against
Savldgo to prevent him from collect
ing the same.
