AN ORDINANCE REGULATING
THE SALE OF MEAT, FISH.
BIRDS, FOWLS, FRUIT, VEGE
TABLES AND OTHER FOODS IN
THEOITYtAND COUNTY' OF HO
NOLULU. PROVIDING -TOR THE
INSPECTION OF SUCH ARTI
CLES, AND PROVIDING FOR
THE APPOINTMENT OF AND
DEFINING THE DUTIES OF IN
SPECTORS THEREOF, v

Section 1, No tnlntcdior decayed
lijcat, fish, birds or fowls, fruit or
vcRotnblcs, nor other food, which Is
not healthy, fresh, Bound, wholo-
tomo nnd fit nnd safe ; tori Human
food, nor nny ment or fish that has
died from disease, shall be brought
Into or offered for snlo as food, or
kept In nny public or private mar
ket within tho City nnd County of
Section 2. AH public and prlvato
markets In tho City nnil County of
Honolulu, together with all tools,
machinery nnd nppurtcnnncpB con
nected therewith, nnd nil articles
therein exposed or offered for sale
ns food or drink, and the contents
of nil lce-cheU and refrigerators in
which any kind of food or drink is,
or may ho kept for sale, shall bo
subject at all reasonable hours to
tho Inspection ot tho City and
County PhjBlcInn, and the Inspec
tors nnd other officers of tho City
Section 3. No person shnll ex
rose or offer for sale, or shall sell
or rnueo or allow to be used as food
or drink nny article which has been
condemned by the City and County,
Phjslclan, or by nny Inspector of
tho City and County. '
Section 4. The stalls, floors,
grounds and appurtenances in and
about nil markets nnd other places
whero nny article Is kept or offered
for salo as food or drink, shall be
Kept In a cleanly nnd wholesome
condition, frea from accumulations
or deposits ot manure or fllth of
Section S. Any bad of badly cur
ed meat or any substnnca which
Is emitting a noxious, deleterious
effluvium shall be forthwith re
moved bf the owner thereof from
the premises where stored, upon no
tice by the City and County Phy
sician or Inspector ot the City and
It after such notice such owner
shall neglect or fall to remove the
same, the same shall bo removed by
such Inspector at tho expense of tho
owner thereof. ?
Section 6. The Board of Su
pervisors ot the City and County ot
Honolulu shall appoint sultnblo per
bonj us Meat and Food, Fish, and
other Inspectors, as may be neces
sary to carry out tho provisions ot
this Ordinance. The salaries of such
Inspectors shall be fixed by tho
Hoard of Supervisors. Said inspec
tors shall have all the powers, and
shnll perform all ot the duties pro
vided in this Ordinance, and shall
have Buch other powers and perform
such other duties as may be hero
after prescribed by the Hoard ot
Section 7. It shall bo tho
duty of tho City and County Phy
sician to exercise practical super
vision in respect to such Meat and
Toad ,1'lsli, and other Inspectors, and
raid Meat and Pood, Pish, nnd other
Inspectors Bhall bo subject to the di
rections at, all times ot said City
and County Physician.
Section 8. It shall bo tho duty
of tho Pish Inspector to oxamlno
nnd Inspect all fish, oysters, clams,
lobsters, crabs and other marlno
products kept or offered for sale
within his district, and it upon such
inspection, said Inspector shall find
nny ot said fish or marlno products
to be In an unsound, diseased or un
wholesome condition, it 'shnll be his
duty to prohibit their sale; and tho
said Pish Inspector Is hereby au
thorized, empowered and directed to
condemn, sclzo nnd remove nny un
sound, diseased or unwholesome fish,
ojstcrs, clams, lobsters, crabs or
other marine products which may be
offered for sale as food within his
Section 9. That In the per
formance ot his duties as prescribed
by this Ordinance., the Fish Inspec
tor shall be, and Is hereby author
ized and empowered to board all
boats, vessels, steamboats and cars,
and to stop all vehicles believed by
him to contain fish or other marine
products, for the purpose of enforc
ing tho provisions of this Ordinance.
Said Pish Inspector shall make a re -
part ot his official doings, weekly, to
the City nnd County Phjslclan.
Section 10, The sale ot fish
and other marlno products Is hereby
prohibited in the District ot Ho
nolulu, excepting nt the new mar
ket building nnd such other places
as shall be specially permitted by
tho Hoard of Supervisors, whore fish
nnd other marine products may be
oxposeil for sale under the supervi
sion ot the Pish Inspector.
Section 11, That It shall be'
tho duty of the Meat and Pood In
spector to attend tho market or msrr
kets within his Inspection district
every morning at the time when the
sales commence, nnd carefully' in
spect aliment, birds Br 'fowls, fruit'
or vegetables offered for sale, and
condemn, seize or cause to bo re
moved such ns may bo diseased, or
from any other cause rendered unfit
for food. Said Meat and Food In
spector shnll make a report of his
official doings, weekly, to the City
and County Physician.
Section 12. All fish left unsold,
nt nny market, nt 6 o'clock p. m. on
the evening of nny day, shnll bo In
spected by tho Pish Inspector, nnd
It found In proper condition may. bo,
placed In cold storage. Buch fish
on 'being again offered tor sate shall
be labeled as "Iced Fish."

vegetables, or other articles ot food

In his Judgment uuwholcsomo and
unfit for use as human food, or In a
condition or of a qualltyl forbidden
by this Ordinance, but with respect
to tho quality nnd condition of
which articles 'of food said Inspec;
tor or other officer may be In doubt,
he shall forbid the salo thereof, and
order that' tho same be set aside,
and Bhall at once notify the City
nnd County Physician of such ac
tion. The City and 'County 'Physi
cian shall thereupon Inspect snld ar
ticles and determine whether tho
same be condemned, and the sale
thereof forbidden, PROVIDED, no
article of food offered or kept for
sale In a decayed or offensive con
dition, shall be allowed to remain
where found, but the same shall be
caused to be removed forthwith by
the Inspector or officer aforesaid.
Section IS, 1 It shall be unlawful
for anyt person to transport any
'beef, mutton, iveal, pork tor the car-4
cass of any animal used for food, or
any fish or other marine 'product,
along any public street, unless such
artlclo bo so covered, or unloss the
vehicle In which It Is transported be
so constructed ns to entirely pro
tect such artlclo from dust and dirt,
and so that tho same may not be ex
posed to view.
Section 10. Any person who
shall molest, hinder or In nny man
ner prevent any Inspector or other
'Officer from performing nny duty
Imposed upon him by the provisions
ot this Ordinance, and any person
who shall violate any of tho provis
ions of this Ordlnanco, Bhall bo deem
ed guilty of a misdemeanor, und upon
conviction thereof shall bo punished
by a fine ot not less than $19 nor
more than $250, or by Imprisonment
for a term not exceeding three
n.onths or by both such fine and Im
prisonment. Section 17. This Ordinance shall
tako offect from and after tho date
of Its approval.

Section 1. It shall bo the duty of
the legally licensed physician who
was last In attendance upon any de
ceased person, or If no physician Was
In attendance, then It shall bo the duty
of tho Coroner to report tho death to
the Olty and County Physician Immed
iately, after auch-death occurs, ( upon
one of. the blanks furnished by? the
City and County Physician for that
purposo, filling in tho blank spaces
so as to gtvo all ot tho Information re-
lqulrod by tho blanks so filled. In
caso of a stillbirth, It shall be tho
duty of .tho legally licensed physician
In charge during the confinement, or
coroner, to report the same Immed
iately as In other cases of death, on
one nt tho blanks above mentioned
furnished for that purpose, giving the

tho City and County Physician to keep
a record ot all tho deaths rcportodto
him under tho provisions ot this Ordl
Section C. Any person who shall
violato any ot tho provisions of ithla
Ordlnanco shnll bo deemed guilty of
a misdemeanor, nnd upon conviction
'thereof shall bo punished by a flna, not
exceeding Two Hundred (9200, DO)
Dollars, or by Imprisonment for n term
