, COUNTY OF HONOLULU."
Ilo It ordained by the People of tho
City nndCounty ot Honolulu:
t Section 1, .No person or person,
firm or corporation shall, in any
manner or for any purpose, break up,
dig, up,, disturb, undermine, or dla
under, or, cause to be broken up,
dug up, disturbed, undermined, or
dug under, any public highway,
street, 'thorough'faro, alley or side
walk, or any other public place in
the City and County of Honolulu,
without hnvlng first obtained n writ
ten permit therefor from tho City
and" County Clerk.
Section 2. Any person,, firm or
corporation desiring a permit to
break up, dig up, disturb, undermine
or dig under any public highway,
street, thoroughfare, alley or side
walk, or other public place In the
City nnd County of Honolulu ahnll
mtik'c application thcrofor, designat
ing tho character and location of
such excavation or breaking up, to
the City and County Engineer or
Itond Supervisor or Hoad Overseer of
tho appropriate district. The City
and County Engineer or Itoad Super
visor or Hoad Ovcrscor shall forth
with file Buch application with the
Cltynnd County pierk, with tho rec
ommendation of surh Engineer or
Hoad Supervisor or Road Overseer as
to the time for which such permit
shall be granted, nnd the nmount of
tho bond, it any such, bond shall be
required as hereinafter prodded.
The City and County Cleric shall
thereupon Issue to the person, firm
or corporation applying therefor up
on the filing ot the required bond
In the amount so recommended, n
permit, limited In time as so recom
mended, to break up, dig uii, dis
turb, undermine, or dig under, the
public highway, street, thorough
fare, alloy or sidewalk, or other pub
lic place ns designated In such np
plication. A separate permit shall
bo required for each placo to be
excavated or disturbed, nnd for each
300 feet In length or fraction there
of of nny .continuous excavation or
disturbance ot any such placo. If
any person or persons, firm or cor
poration desires such permit for tho
purpose of laying underground wires
for any telegraph, telephone or sig
nal system, tho application for uch
permit shall bo mado direct to the
Hoard ot Supervisors, nnd ns a con
dition to tho granting ot such per
mit tho Hoard of Supervisors may
require such person or persons, firm
or corporation to furnish to tho City
and County ot Honolulu, nnd place

Section 3. It shall bo tho duty ot
the , City and. County Engineer, and
of the respective Itoad Supervisor or
Itoad Overseers to oversee and in

turbanccs for which a permit has

permit .shall .bp laaued by ttio City
and County Clerk, tho ' applicant
thercforhall pa)f to the City, and
County '(Clcrk to 'cover 'the cost ot
such Inspection and, tte Issuance, ot
such pormlt, a, 'permit fee' of- tho
sum ,of fifty conts. All permit fees
collected' by the City and County
Clerk under tlils Ordinance shallbe
turned 'over to the City and County
Treasurer a't the end of each and
every month.

agent thereof, for or on account ot
any Injuries or damages to any per
son or persons, or property, received

or about the work covered by such,
permit, or by or on account of any
accident in .connection therewith, or

servants, and to pay to the City and
County of Honolulu1 any penalty re
covered against the. person 'to whom

expense which may have been in
curred by the City nnd County of
Honolulu by reason ot nny violation
hereof by such person, or by his
ngents or servants. Sureties on sucli
bonds, shall severally qualify beforo
the City and' County Clerk in tho
amount of ,tho penal sum specified
therein. In 'lieu of the bond abovo
provided, the bond of a sursty'com- '
pany authorized under the law or
tho. United State to becomo surety
on 'bonds of public offlccis, nnd, law
fully doing business in the Territory
of Hawaii under tho laws of tho
United States and ot the Territory
of Hawaii, may be accepted.
Section 6. Any pcrsoh or persons,
firm or corporation,, who Bhall havo
broken up, dug up, disturbed un
dermined or dug under, or caused to
bo broken updug up, disturbed, un
dermined or dug under ' any publlo
highway, street, thoroughfare, 'alley
or sidewalk, or any other publlo
placo in th City nnd County of Ho
nolulu, under nny permit granted
under' tho provisions ot .this Ordin
ance, shall forthwith, after tho com
pletion of tho work under such per-'
mlt, plnce and put such public high
way, street, thoroughfare, nllcy or
Bldowalk, or other public placo in na
good repair and condition in every
respect and particular as tho snino
wns before such breaking up, dig
ging up, disturbing, undermining or
digging under,, nnd upon falluro(so to
do, tho District Road Overseer or
Itoad Supervisor may cause fho w'orlc
necessary tnerefor, to bo done, ami
the person or persons, firm or cor
poration to whom Buch permit was
Issued, shall be liable for the expenso
thereof to the City and County ot
Honolulu, nnd In nddltlon thereto
shall be liable In a criminal action
to the penalties hereafter provided
for violations of tho provisions oC
this Ordinance.
Section 7. Tho City .nnd .County
Clerk shall keep on file all recom
mendations Issued by the City and
County Engineer or Itoad Supervi
