BREAKING UP, DIGGING UP,
AND DIGGING UNDER THE
PUBLIC HIGHWAYS, STREETS,
THOROUGHFARES, , ALLEYS,
SIDEWALKS AND .OTHER PUB
LIC PLACES IN THE CITY AND
COUNTY OF HONOLULU.

City nnd County of Honolulu:
Section 1.' No person or person,
firm or corporation ehnll, In any
manner or for nny purpose, break up,
dig. up, disturb, undermine, or dig
under, or causo to be broken up,
dug up, disturbed, undermined, or
dug under, any public highway,
street, thoroughfare, alley or Bide
walk, or any other public placo In
the City and County of Honolulu,
without having first obtained a writ
ten permit thorcfor from the City
and Couniy Clerk.
Section 2. Any person, firm or
corporation desiring a permit to
break up, dig up, disturb, undermine
or dig1 under any public hlghwn.

excavated or disturbed, and for each
300 feet In length or fraction there

Section 3. It shall bo the duty of
tho City and County Engineer, nnd
of tho respectlvo -load Supervisor or
Hoad Overseers to oversee nnd In
spect all cxca-iatlons and other dis
turbances for which a permit has
been granted, nnd before any such
permit shall bo Issued by the City
and County Clerk, tho applicant
therefor Bhall pay to the City nd
County Clerk to cover the cost of
such Inspection and tho issuance of
such permit a permit fee of tho
sum of llfty centB. All permit fees
collected by the City and County
Clerk under this Ordinance shall bo
turned over to tho City and County
Treasurer at the end of each and

a bond, to' tho City nnd County of
Honolulu, with two Kuretles. In such
sum us may be designated by said
City oud County Engineer or Hoad
Suponlsor or Iload Overseer. Tho
condition of such bond shall bo to
Indemnify and Bnve harmless tho City
and County of Honolulu, nnd tho
offlccis nnd agents theicof, from all
claims, demands, suits, actions or
proceedings of oery name, charac
ter and description which may be
bi ought against said City and Coun
ty of Honolulu, or any officer or
agent thereof, for or on account ot
any Injuries or dnmnges to nny par
son or persons, or property, recehed
or sustnlned by any person or per
sons, firm or corporation, by or In
consequence bf nny net or act. ol
tho person to whom such permit Is
Issued, or Ills agents or servants In
or about tho work covered by BUch
permit, or by or on netotint of any
accident In connection therewith, or
by or on account of any violation
of any of tho provisions ot this Or
dinance by the person to whom such
permit Is issued, or by his ngents or ,
servants, nnd to pay to the City and
County of IIonolulu'nny penalty re
covered ngnlnst the person to whom
such permit Is issued or his agents
or servants for any Iolation ot the
protltlons ot this Ordlnanca nnd any
expenso which may hnvo been In
curred by the City nnd County of
Honolulu by reason of nny violation
horeof by such person, or by his
agents or servants. Sureties on such
bonds shall severally qualify before
tho City and i County Clerk In the
amount ot tho penal sum specified
therein. In lieu of tho bond above
provided, tbo bond of a surtty com
pany nuthorlzcd under tho law ot
the United Stntcs to become surety
on bonds ot public officers, nnd law
fully doing business In the Territory
of Hawaii under the laws of the
United Stntcs nnd of the Territory
of Hawaii, may be accepted.
Section C. Any person or persons,
llrni or corporation, who shnll have
broken up, dug up, disturbed, un
dermined or dug under, or caused to
be broken up, dug up, disturbed, un
dermined or dug under nny publla
highway, street, thoroughfare, alley
or sidewalk, or any other public
place In th City and County ot Ho
nolulu, under nny permit granted
under tho provisions of this Ordin
ance, shall forthwith, after the com
pletion ot tho work under such por
mlt, place nnd put such public high
way, street, thoroughfare, alley or
sidewalk, or other public placo in a.
good repair and condition In cveiy

dinance, and shall keep a duplicate
of all permits issued by him here

firm or corporation, who shall vio
late any of tho pnnlslons of this
Ordinance, sti-tll bo deemed guilty ot
a misdemeanor, and upon conviction
thorcot shall bo punished by fine not
exceeding $2.0.00, and not less than
5.00, or by imprisonment not ex
ceeding jhreo months, or both.
Section 9. , This Ordlnanco shall
tako effect and bo In force from and
after tho date ot Its approval.
