AND DIGGING UNDER THE
PUBLIC HIGHWAYS, STREETS,
SIDEWALKS" AND OTHER PUB
LIC PLACES IN THE CITY AND
COUNTY OF HONOLULU;

City and. County of Honolulu:

manner or for any purpose, break up,
dig up, disturb, Undermine, or dig
under, or cause to be broken up.

Section 2. Any persod, firm or
corporation desiring a permit to
break up, dig up, disturb, undormino
or dig under nny public highway,
street, thoroughfare, allcyor slde-
wniK, or other puunc place in ine
City nml County of Honolulu shall
make application therefor, designat
ing the chnracter and location of
such excavation or breaking up, to
the City and County Kngincer or
Itoad Supervisor or Uoad Overseer of
the appropriate district. The City
nnd'County I'nglncer or "load Super
visor or Road Overseer shnll forth
with flic such application with the
City and County Clerk, with the rec
ommendation of such Engineer or
Road Supervisor or Rond Overseer as
to the time for which such permit
shall be granted," and the amount of
the bond, .It any such bond shnll be
required as hereinafter prodded.
The City and County Clerk bhnll
thereupon Issue to the person, firm
or corporation nppl)ing therefor up
on the filing of the rciTulred bond
tu the amount so recommended, a
permit, limited In time as so recom
mended, to break up, dig up, dis
turb, undermine, or dig under, the
public highway, street, thorough
fare, alley or sidewalk, or other pub
lic place as designated in such tip
plication. A siparnte permit shall
he required for each plnce to bo
excavated or disturbed, and for each
300 feet In length or fraction there
of of any continuous excavation or
disturbance of any such place. If
any person or persons, firm or cor
poratlon desires such permit for the
purpose of laying underground wires
for any telegraph, telephone or slg
nal syBtcm, the application for such
permit shall be tnado direct to the
Hoard of Supervisors', nhd'as a con1
dltlon to tho granting of such per
mlt the Hoard of Supervisors may
require such person or persons, firm
or corporation to furnlsh'to tho City
and County of Honolulu, and place

Section 3. It shall be the duty of
tne city and County Engineer, and
of the respectlvo Road Supervisor or
Road Overseers to oversea and In
spect all excavations and other dis
turbances for which a pormlt has
oeen granted, and before any such
permit shall be Issued by the City
ana- county Clerk, the applicant
therefor sHhlt pfty to the City and
County Clerk to cover the 'cost oj

such permit, a permit fee of the

Section 5. Whenever required by
the City and County Engineer 01

nny person or persons, firm or cor
poration applying for such permit
shall, before such pprroitrls Issued,

a bond, to tho City and County of
Honolulu, with two suiotlo-i. in such
sum as may ho designated by said
City and County Unglnccr or Road
Supervisor or Road Ovorscer. The
condition of such bond shnll be to
Indemnify and save harmless the City
nnd County of Honolulu, and the
officers and agents thoreof, from all
claims, demands, suits, actions or
proceedings of every name, cliaruc
ter and description wh!,ch. may tho
brought against said City and Coun
ty of Honolulu, or any btSxer or
agent thereof, for or on account ol
nny Injuries or damages to any per
son or persons, or property received,
or sustained by dny 'petson or per
sons', firm or corporation, by or in
consequence of any act, or acts ot
the person to whom such permit la
Issued, or his agents or servants in
or about the work covered by such
permit, or by or on account ot auy
nccldent In connection therewith, or
by or on account of auy violation
of any ot the provisions of this Or
dinance by the pcrsou to whom such.
permit Is Issued, or by his agenU or
servants, and to pay to the City and
County of Honolulu nny penalty re
covered against the person to whom
such permit Is issued or his ngents
or servants for any violation of the
provisions ot this Ordlnnnco and any
expenso which may have been In
curred by the City and County oC
Honolulu by reason of any violation
hereof by such person! or by his
agents or servants. Sureties on such
bonds shall severally qualify bororo
tho Cltv and Coilhtv Clerk in tho
amount ot the penal sum specified
therein. In lieu of the bond nbovo
provided, the bond of a surtty com
pany authorized '.under the law or
the United 8tatc to becomo surety
on bonds of public offlcors, and law
fully doing business In tho Territory
of Hawaii under tho laws ot tho
United 8tates. and of the; Territory
of Hawaii, may be accepted.
Section 6. Any person or persons.
firm or corporation, who shall have-
broken up, dug up.- disturbed, un-
dormtned or dug under, or caused to
bo broken up, dug up, disturbed, nn-
dermlncd or dug under dny public
highway, street, thoroughfare, alloy,
or sldowalk, or any other public .
place In th City nnd County ot Ho
nolulu, under any permit granted
under the provisions of this Ordin
ance, shall forthwith, after tho com
pletion of the work under such per
mit, place and put such public high
way, street, thoroughfare, alley or
sidewalk, or other public place In as
good repair and condition In every
respect and, particular as the sntne
was before such breaking up, dlt
glng up, disturbing, undermining or
digging under, and upon failure so t0
do, tho District Road Overseer or
Road Supervisor may cause the work
necessary tnerefor to be done, nnd
the person, or persons, Orm or cor
poration to wbomvsuch permit was
issued, shall be liable for the expense
thereof to the City and County ot
Honolulu, and In addition thereto
shall be liable In a criminal action
to the penalties hereafter provided
for violations of the provisions ot
this OrdlnSnce. ' "
Section 7. The City nhd County
Clerk shall keep on fllo all recom
mendations Issued by the Olty and
County Engineer or Road Snpcrvl
sor or Road Overseer under this Or
dinance, nnd shall'keep a duplfcato
of all permits Issued by him here
under. Section 8. Any person or persons,
firm or corporation, who shall vio
late any of tho provisions of this
Ordinance, shnll be deemed guilty ot
a misdomcanor, and upon conviction
thereof shall be punished by lino not
exceeding S2G0.00, nnd not less thntt
5.00, or by Imprisonment not ex
ceeding three months, or both,'
Section 9. This Ordinance shall
take effect and bo in force from and
after the date of Its approval.
