filed with the county clerk jestcrday
by Rudolph and Otis Spreckels, ex
ecutors of tho will. This means that
the Supreme Court will be required
to rtaBs upon the validity of the
trust clauses of the will.
The ruling of Judge Coffee, ren
dered Tebruary 18, 1910, after nn
exhaustive argument between the at
torneys and a closo study of the law
nnd precedent by the Judge, was a
victory for John D. Sprockets nnd
Adolph II. Spreckels, brotheisot tho
exeputors. John D. and Adolph
Spreckels received nothing under the
will, their father stating that he
had given them large sums of money
In his Iffetlme. The ruling declared
the trust Invalid anil .made all but
the community portion of the estate
equally divisible among the flvelhll
dren of the testator the four sons
already mentioned al.d Mrs. Emma
C. Ferris.
The attack on the trust took the
form of a demurrer to a petition of
Rudolph and Qus Spreckels for dis
tribution to themselves as trustees
for their inothor, Mrs. Anna C.
