Be it further enacted, etc., That g11 sinks and privy vaults now attached to, or connected with any building situate within the urban limits of the city of New Orleans A shall l, filled up by the owner or owners of the property whereon the sink, vault or vaults may be situated within one year from the passage 1 of this act, and in such order as the Board of Health may from month 9 to month direct, and it shall he the a duty of the said Board of Health to I designate each month, by streets, or squares, such part or parts of the city of New Orleans wherein the sinks or privy vaults may from a overflow or or other causes be most a prejudicial to health and the owners of premises so designated shall fill up the sink, privy vault or vaults thereon, within three months from the date of notification by the said Board of Health and this system of closing up sinks or vaults shall be gradually extended until it shall, within~d~ year, cover the whole i city of New Orleans and may be t extended thereafter by the said 1 Board of Health to any new area which may hereafter le inclrpor:,. ted within the city limits. t Sec. 3. SSec. 4. Be it further enacted, etc., That should any owner or owners of any building or buildings situated within.the urban limits of the city of New Orleans, fail to have the sink, privy vault or vaults icnnect ed therewith tilled up within the prescribed time, it shall then be the duty of the said Board of Health to cause the said sink, privy vault or vaults to be filed up at the expense of the said bwner or owners of said premises, and the contractor or person employed for that purpses shall have the right to sue inl his i own name to recover the expe.ns.es so incurred. Sec. 5. Be it fmtlrther tenacted, etc., That "The New ()rleans S:anitary and Fertilizing C'oimpaiy" hall have the exclusive right and lprivilcge, for the period of ten yearsn , to com mence from tie passage of this act, to remove any and all feal matter, excrement or fertilizing material which may be accmnulated under the operation of the "Dry Earth System," on any premlises situated within the urban limits of the city of New Orleans; prorided, the said company shall, when required by the owner or occupant of any buildl ing or tenement, or 3by the Board of Health, supply suitably prepared deodorizing and disinfecting mat erial in sufficient quantities to deodorizing and disinfecting mater ial in sufficient quantities to deo dorize an. disinfect well arranged earth closets, and shall, for supply ing said disinfectant, anmd removing the said product, charge no more than one dollar for each box of movable vault holding not less than twenty gallons, and shall, also, upon proper aplicatdion, furnish for sale earth'closets, with movable vaults holding not less than twenty gallons each, or at a rent of not more than twelve dollars each per annmaum. Sec. 6 Be it further enated, etc., That the New OrleaSanitary and Fertilizing Company shall have power to increase their capital stock to five hundred thousand dollars, in shareo not lem than one huan dred dgiys each, at such time and in much manner astheirboardof director may diect;provied, that two hundred thousand dollars of the auoaunt shall be upon subscrip tion by any owr.er of real ,.;tatse or, occupant of proerty situ:al,'i ithl in the urban limits of th. c ;it f N, New Orleans, notice of which shall be given within thirty days after the passage of this act, in two daily joirnals published in the city of New Orleans, and subecriptions thereto shall be received at the of fice of the company for ninety days thereafter, between the hours of nine A. M. and three o'clock P. M., unless sooner taken, provided no subscriber shall, in his own name, subscribe for more than ten shares. - Sec. 7. Be it further enacted, etc., hat all laws and parts of laws in contravention of this act be, and they are hereby, repealed, and that this act shall take effect from and after its passage.
