THIS day comes the complainant by hi solicitor, and it appearing to the tattf faction of the Court, on the affidavit of stir) complainant, that said Richard Garrett is not a resident of this State. It is therefore on dered that said defendant be notified by publication of this order to be made in some newspaper printed in this state for eight weeks sucessively; the last insertion to be made at least four weeks before the nesr May term of this court; that said complainant has filed in this court his btfl'of complaint against him. stating in substancw-trwt the de fendant in the year 1 839, proved in the Land Office, at Palmyra Missouri,, his right of pre emption to the N. E. quarter of section 30, township 51. range 2 west of the 5th princi pal meridian in LinrTn county, containing; 160 acres; that saier eomplainant rubserraeat ly purchased of said defendant all his right and title to s.i'hI pre-emption to said tract of land, by an instmnent of writing signed by said defendant for tne consideration of 525 dollars. 325 d offers was paid in hnnd that the remainder of so id consideration, to wit, 200 dollars was to be retained in the. hand ofsaid complainant to clear the said land out of the land office, as specified by said writings mat oy anomer writing saia aeienaant Doutuf himself to make to said complainant a deed to said land, and to warrant and defend the title thereto to said complainant, and to give said complainant possession thereof, that m pursuance of said writing, said complainant took possession of said land and still holds possession thereof; that said complainant paid to the receiver at said land office, the said sum of 200 dollars as agreed aforesaid, and obtained from the land office the title of the Government of the United States, to said land in the name ofsaid defendant; that said defendant has left the state, and has not made to said complainant a title for said tract of land, and prays that said Garrett may be made defendant to said bill; that he make full and specific answer, and that this court will decree the title of said tract of land to said complainant, Sec. Therefore, you, the said Richard Garrett, are hereby required to ap pear at this court on the first day of the next term thereof, to be begun and held at the Court House, in the town of Troy, on the first Monday in May next, and answer said bill of complaint, or the same will be taken for contused against you; and this cause is con tinued.
