And we should not forget that our friends from hero and elsewhere deserve the thanks of tho community for faithful and pcreistont work in bringing about the result. Onk of tho reasons urged by the representatives ol Claremore and Afton against making a payment at Vinita was that there was no grass growing in our streets on which tho people could pasture their horses. That, gentlemen, is a fair and honest statement of the caso and tho party who advanced that idea had certainly been on the ground and knew what ho was talking about. No one should bo silly enough to think ior a moment that Coxey's army represents the laboring classes of this country. They rep resent tho very opposite. Thero are no doubt a good many thous and honest laborers out of imploy ment at tho present time in the United States, but they arc not with tho army of loafers har"-f yo satisfactory to a commonwcalcr 'as a "handout," and thoir ranks are full of men who havo refused to work. In tho second proposition made by tho Dawes commission tho chief diflerenco from the first ono sub mitted is tho enfranchisement of tho non-citizen elomont of tho country. Tho commission doubt less foresaw tho difficulties that would have been inevitable under a system that allowed minority rulo. It is very probablo that such an agreement would havo caused trouble. Whenever tho fivo tribes aro included in a "state or torritory of the United States, the right of suffrage will inure to all aliko. The Chieftain regrets tho necessity of protesting against any body or anything that sets itself up in Vinita, but, it ventures now an earnest protest against the establishing of any more saloons and gambling houses in this town. Wo havo never underated any good thing that has been even at tempted, but if the schools and churches hore are entitled to re Bpcct, if our wives and children deserve any consideration, in short, if we appreciate any obliga tions that we owo to society now is tho time to speak out. According to the last census thero are about 25,000 C'herokees by blood, 3,000 colored citizens. 777 Shawncos, making a total of 31,0-12. Wo have left 4,-lS8,000 acres of land, which if divided would glvo each citizen somewhere near 150 acres. If one half tho public domain is good enougii to build a home on, the Bizo of that homo would bo 75 acre; yot some individual citizens aro occupying several thousand acres each. A very small homestead id all any citizen would get if tho country was allotted now, and it is getting less and less. If thoso members of tho senate and council who fought Vinita so persistently in tho recent contest to secure a payment think that Vinita is not "keeping tab" on them thoy aro surely mistaken. Tho member of either house from Delaware or Cooweescooweo who does not look after tho wants of this town, docs not proporly rep- nresHt his district. Scarcoly a month has olupscd since, tho creation of Senator Teller's commission, yot tho most thorough and exhaustive report ov er imulo with rcforenco to tho fivo tribes has already gono forth. Doubtless Senator Teller and his colleagues wero greatly assisted in their labors by tho Dawes commis sion, lit at is now hero and is mak ing tho most thorough investiga tion of affairs. Tho problem of pre paring remedies lor tho ovils exist ing here has at last been un dertaken, and both political parties are in harmony and in favor ofsolving.it at once. Special stress is given in tho report to the inefficiency of tho judicial system hero, as is also to tho school sys tem. Mr. Teller seems to have been astounded at tho number or non.citizon childcrn denied tho privileges of an education hero. THE PART OP W13DOM. Thoso who aro ranting against a change of land tenure in the five tribes should stop long enough to reflect that this land which by sol emn treaty was to bo tho common property of tho Indians forever has gradually drifted away from tho real Indian and into tho hands of a few men who havo appropri ated all the agricultural and all the ran go land, and are now in posses sion of it right under tho eyes of tho Dawes commission. Is any one so dull as to supposo for a moment that'these facts aro not going straight to Washington, and th tit their frantic efforts to beat back tho change that is inevitable will only servo to accelerate the movement that is now on to change these tribal governments? The change may be fraught with ill re sults to tho pcoplo at largo but it need not necessarily bo ii our peo ple would fall into line, tako hold with tho Dawes commission and savo as much as possible out of tho wreck. It would certainly be the part of wisdom. The question of forfeituro of citizenship by white adopted citi zens "marrying out" of the nation, has begun to attract considerable attention of late. At the recnn term of circuit courl :" lworo district r - case9 were - -iicsea oecause, as the court held, it was the duty 'of tho attorney general to bring men suits, and that tho law creating tho ofnee of attorney general annulled the law making it the duty of solicitors to prosecute such suits. If the statute of limitation obtains in these cases, their dismissal would simply moan a chance to take ad vantage of the law. If Senator Berry's amendment to the sundry civil hill, introduced last week, providing for an appro priation of 8100,000 to pay tho ex penses of survoying tho lands of tho fivo tribes should becomo a law, our tribal system would have to go. At least it shows the trend of congressional action with refer ence to this country. Senator Berry is a friend to the five tribes and more especially to tho Chero kces, but ho evidently understands tho condition of affairs here to bo such as to warrant drastic meas ures. Great events are in store for this Indian country. Haiidly a day passes now with out the Washington dispatches an nouncing "another blow at the five tribes." Tho most powerful and influential commission ever sent to this country by the United States government hummering away in our midst and the atten tion of congrecs constantly being directed this way, should be con vincing to all reasonable minds that we will havo to submit to somo sort of a change. States manship would suggest that we endeavor to make tho very best terms possible. THE PAYMENT BILL. A fow Unimportant Ohunsros Pos sibly Mado. Bo it enacted by tho national Council, That the duly commis sioned treasuror of tho Cherokoe nation be, and ho is heroby authorized on behalf of said nation to make requisitions upon the sub. treasury of the United Slates in which the sum of 80,740,000 is on deposit subject to tho order of the Chorokeo nation by authority of act of congress, and to receivo and receipt for same, and to make dis position thereof in the way and manner and at tho time and place hereafter specified, to wit: Ho shall make requisitions for 81,173,U33.CG in time to enable him to begin the per capita pay mont as hereinafter provided and directed and for tho same amount atsuoh intervals of limo thereafter as will nnablo him to contiuuo and complete the said payment as speedily as possible. Provided, that before proceed, ing to mako requisitions and to receivo and receipt for any monies by authority of this act tho na tional treasurer shall bo and is re quirod to mako and file an addi tional bond with sureties salWfao tory to the principal chief In the amiwiOKI H U , r r ! sum of 81000,000, conditlonod up. off his fivthful compliance with tho rcnuiKnient8 of this act; -and all kinds 0 property except im provemcnts'Vipon tho unsurvoyert common domain may bo taken as security In such additional bond. Section 2 Tho sum of $100,000 out o tho said $0,740,000 rlia)l bo m. and is horcby set apart to bo up plied Tor general purposes includ ing tho payment of tho expenses necessarily incurred by this act Tho ronunude to wit: 80.010,000 shall ho paid by and under the supervision or tno national treas urcr in equal sharos to citizens of the Cherokee nation by virtuo of thoir Cherokee blood and descent, whoso names shall bo registered as such on tho census taken and completed by authority of an act of the national council," approved on tho tho 15th day ol April, 1S93. Section 3. From said complet ed census the treasurer shall cause a pay or receipt roll to bo copied for each district with tho names of all thoso Untitled to draw, arrang ed in alphabetical order, with numbers in family, with names and ages of the members rospect Ivcly attached. To do this work ho is authorized to employ a sufficient number of expert and capable copyists, not morn than two for each district roll, to labor under his supervision and direction, whose compensation shall bothrco dollars and fifty cents per dc.'y certified to by tho treasurer. A similar pay roll shall bo prepared of tho pupils of tho Orphan Asy lum. Tho said pay rolls when finished shall be carefully compar ed with tho original census, and be certified to as true and correct ny tho copyists and turned over to the treasurer to bo his guide in making tho said payment, by or before tho 20th day of May, 1S94. Sec. 4. Bo it further enacted; That thero shall bo olected by the national council an officer entitled "commander of guards" whose term of sorvico shall bo during the said public per capita payment and whoso duty shall be, with tho men under his command to vigil antly see to tho preservation of the peace at tho places ol payment and vicinity while the same is progressing and to guard the treas urer and Ins asnistaiits and effects in their charge from all interfer ence or interruption durincr the said payment. The said ollicer shall be under tho direction of tho treasuror in all matters relating to the conveyance and protection of the public lunds and shall receivo for his services three dollars ami fifty conts per day. It shall be his duty in conjunction with tho treasuror to select n sufficient number of discreet, reliable and resolute men, to be chosen from both political parties equally, to preserve the peace at all times and lit and about the -ca "i ".Jin 1116 same until tho general payment is concluded, who shall be discharged for disobedience to any order or discipline required of them. Provided, Tho number of may bo increased or diminished, as in their judgment, c'umstances may require or justify. Each guard appointed by tho commander and treasurer shall be sworn to faith fully and promptly obey the orders of the commandor and may he removed for noglect or refusal so to do, or for other causes deem ed to be sufficient by tho com mandor and treasurer. The pay of each guard shall be two dollars por day payable at the closo of his sorvico on the certificate of the treasurer and commander, a regis tcr of which, certificate as well as of nil others issued by said com. mander of tho board of guards and feed of horses, shall be transmitted to the principal chief at tho close of tho payment. Sec. 5. Bo it further enacted, That Cherokee women who have intermarried with whito men ac cording to law and who are enroll ed at Iho bend of the family shall 1 -- irnuxiL in iiiiii oc paid the lamily per capita ac cordingly. When it shall como to tho knowledge of tho treasurer that the parents of any family are living apart and estranged whithout hav ing been legally separated, tho treasurer shall retain in the treas ury the money belonging to tho minor children of such family (if any) until Iho question of tho right to tno custody or the children shall be determined by duo course ol law or by agreement ' between the parents duly signified to tho treasurer by both parties whether one or both parents be Cherokees or not. The per capita shares duo to tho inmates of tho Orphan Asylum shall be retained in tho treasury in all cases until tho orphan comes of age. In all other oases whoro no porsons shall apply to draw (he per capita share of another by authority of lotUiM ol guardian ship, tho treasurer shall require proof satisfactory to himself before making payment, that a bond has been film! in double tho sum ap plied for to he drawn, in aceoid ance with law. That in all cases where tlfo head of a family, 01 person enrolled singly, shall be by roason of old age, diseaso or other good and sufficient causo, rendered unable to apply in person to be paid the amount which such person is entitled to draw, tho person so unablo and entitled shall have tho right to givo an order for tho amount dun, and bo paid in full through the person presentiuv the order provided tho order shall be duly signed and attested by the giver as genuine, under oath, and and bear tho signatures of two ro. snecfable persons as witnesses.
