that this Act abuts of tbe Bar of this Court from

thus there la created a monopoly in tbe present

Bat the law lmperatiTe ; none but Uasraiian
Ettbjecis can be admitted to practice here, and we

It ii said that as this section (IMS I of the Code '

list it is said that this law is merely directory

The provision we are now conaideriii seems to
us to be compulsory and to leave no discretion in
tbe Court- Joneof tbe adjudsedcaseswecan find

It 19 said tbat the acts referred to arc an encroachment
upon tbe judicial authority ; that the
Court baa an inherent power to say who are
to be admitted to practice before it While
recocnizins the force of this, it is also true that it
u tbe duty of tbe Court to admit tbe bindinf:
force of a law restriction tbe imetiuouers, if
reasonable, and we cannot say that tbe restrictlou

operation of Acts' of tbe kegielautrc, unfit persona

advantage of a bar of laofeHaonal exeellencr.

Numerous references are made in argument lo
Treaty .tipulatioua for example Art. of the
Vritiah Treaty that a " British subject ia this

it Is evident that this refers to

to the privilege of law. Also Mb Art.

Supreme Court of the Hawaiian Islands
In Banco. Heard March Ith, 1887.
(""' L. IIorKiss vs. Calico AVi.ia a-
I concur is tbe condueions reached by the Chief
Justice, and substantially in tbe tapussiuu or Ids
views upon the two points to whkk eieepttoa is
taken. Aa his decision has been published it will
not be necessary to repeat the matter which has
been presented by him with ample learning. This
case must rest upon tbe rales of law declared in
the Banbury Peerage case, and most fully discus
cd is tbe House of Lords' case of Morris v. Davis.
The decision of tbe Chief Justice having been
made a part of tbe bill of exceptions in this case,
I take from it this statement of fact by tbe Court
vie " In the case before me then was no attempt
to how non -access of tbe husband. J he evidence
of an intimate acquaintance of the famdy is to tbe
cflect that durinr; the period covered by a year or
more previous to tbe birth of plauithT.Kaiawa and
his wife lived together up stairs in n bouse in which
Hopkins senior lived." t'jwa litis stUtemeiit it
appears to me that by tbe third answer is the Uan-bury
Peerage case no other is adnncstWe
to Ehow tbat another person than the sard husband
was the father of tbe wife's offspring. If this rule
be abandoned in a case ot such facta aa above
elated, I am unable to rest upon any rtber definite
rule for tbe df termination of legitimacy. If we
once admit evidence to show that while a wife cohabits
with her husband he not being shown to be
incapable of besetting offspring another man also
shares her bod, and her offspring are to be assign
cd to tbe one or the other as they may appear from
the complexion and other resemblances to belong
to either, we shall find ourselves called upon tu
disturb the sccunty of descents upon every suspicion
of tinfaithf illness which after a long time
may be dieted in proof.
lherc is a special propriety in applying the rule
is the case before us where tbe question is of the
leptimacy ot tbe otUpring of aliawanan woman,
for the ancient Hawaiian rule was to regard
J hiefly tbe mother in questions of descent, for it
could always be determined who was tbe
mother.
In respect to the term of the lease, I bold that tbe
- another term of ten years or so Ions
aaseorisrepreser .uvea may desire tbe same'
Kave the lessee nothioK mure, at tLe most, than a
second term of ten years, and that this bavins expired

In this case the testimony substantially shows
that the plaintiff mother and her lawful husband
were natives. That for
pn to the, plaintiff's birth they lived together
as husband and wife up stairs in a bouse
in which lived Charles Gordon Hopkins, a white
man. That the plaintiff at his birth was nuscd
Charles lU HopUns, ,nd
was up as the
son of Charles Gordon Hopkins, and was treated
as such by him and by his mother and her said
husband; and his appearance strongly shows an
rn mixture of white and native blood.
By these facta I think Uiatthepren,pUonof
lepUmacT is counttrvailed. 1 do not thank that
tha ride in the Banbury Peerage case should be
applied in' this case: and I reepeetfullr dissent
from the opinion of the majority ot the Court that
the pUinliff is legitimate.
