Opinion of the Chief Justice.
This is an action of Ejectment for the pos
session of all that tract of land situate in Ka
lia, Waikiki, Island of Oahu, being more fully
described in Royal Patent number 3H1 to
Alapai, containing 6-10 acres. Tho plain
tins claim that on the death of Alapai in 1 -53
or previous, probably in 1651, he left a
daughter Nihoa. She died in 1859orlS69,
leaving a husband Kalauao who still survives,
but no issue. At the time of Xihoa's death
there survived Kaoho, who was sister to Xi
hoa's mother (Xaainilali). This Kaohe was
the wife of the well known JIaior JI. Maliuka.
On her death he married Luukia and thia
couple had issue the plaintiff Mahnkaliilii.
It is claimed that Kaohe inherited the estate
of Xiboa, and ou Kaohe's death without and
kindred it passed to Mahnka her husband, ac
cording to tho statute ; and ou Mahuka's death
the estate descended to his son the plaintiff
Mahnkaliilii, his widow Luohia leing entitled
to dower therein.

To Burglar and Others
A case w hicli has been decided at tho Liver
pool Police-court suggests a danger Iwth to
burglars and the public whih has hitherto
leen ovci looked. A householder iti England
has generally been under the impression that
after he has seen that the windows have been
securely fastened, and has 1 ml ted the f.ont
door, he can retire to rest in perfect uccni ity;
and as for the burglar, the preliminary pre
caution of taking off his boots before break
ing into enclosed premises has aluajs ap
peared in tno jigiuci a very reasonawe method
of a oiding detection. Doth these icws mav I

aiscovery in the distant future as uu interest
ing human relic, when the house is puS
down, ho should always adopt the precaution
before descending a chimney of leaving his
boots on-the front doorstep to indicate his
whereabouts to tho tinlice. This was the only
thing Ihit aarcd the'lifo of tho Liverpool l.ur
iar in question, lie had taken off his boots
in order to tread noiiclessly. lie had climbed
to the roof of a jeweller's shop: he had taken
off the chimney-pot, aud had descended the
chimney which led to the store-room. Here,
however, one solitary obstacle present itself;
the chimney bad been, bricked up by the pro
prietor, and the burglar remained a prisoner
from midnight on Tuesday until tho afternoon
of Wednesday, shouting contrary to the usual
practice of burglars for the k1icc! Thcdis- I

chimney led to thoculprit. He was hoars o
