Looking at the answer in this case standing by
itself, and considering that the information and
belief of the petitioners, as to the Jlinister
intended act, must relate to and from after the
time when the Xandamns which had been imposed
en the repoadent was dissolved; it appears to
meet dearlT and to deny fally the act charged to
be intended. The respondent denies absolutely
that be intends to isauo bonds for certain or any
tilrer coin not of the Talne of U. S. gold coin or
its equiralent, or that he is now or any time or at
all about to inane bonds except as authorized hy
law. By the pleadings the law mnst bo taken to
mean rprdally the Loan Act of 1S82. Cb. XXIX,
That statute has now been interpreted by this
Court. There spondent in that case mado answer
according to Us Tiews of the law in respect to par
Talne, cqmralcnt to V. S. gold, etc, which were
oremiled by the Coort. Ilts present answer must
be taken to DC accoraing io uic law as u naa eidco
been determined by judicial authority.
The law as to the dissolution of injunction upon
answer docs not seem to be in controTcrsy. I will
take it as cited by petitioners counsel in S Bar
bonr'a Chancery Practise, page CIO.
An injunction will not bo dissolved on the
coming in of the answer, aniens the defendants
positively deny all the equity of the bill. And it
seems that eTcn wben all the equity of the bill is
denied by the answer, it is not a matter of conn
to dissolve the injunction, as the granting and
continuing an Injection alwiyi rests in the sonnd
discretion of the Court, to be governed by the
nature of the case. The statement of the defend
ant mutt be at least creditable. Any evasion in
not responding to the charges in the bill, or an
extreme improbability in the statement of the
defendant, will induce the Court to retain the

in good faith that the respondent Is not about to
issne bonds "in any other manner, or for any
other moneys, than Is provided for by law," as

The bill is therefore dissmisscd and the tem
porary writ granted ez parte writ dissolved.
