tho Minister of Finance there was an
item of some 528,000 as a Japanese fund,
There was no doubt that tho money was
received according to that report, and fnr
ther confirmation on that subject was had
by expression that fell from the Minister
of Foreign Affairs, that money had been
paid back to parties depositiag it

Hon. Godfrey Rhodes said, there was
something irregular in tho information of
the Minister, the principal ought to bo
provided for as well as tho interest The
fourth section of tho Annronrintinn Tii'll
defines especially that money shall not bo
paiu irom uie Treasury witnout authoriza
tion of law. If thoso were not certificates
of deposit they should not bo in the Ap
propriation Bill, but as they were there,
this sum appoars as on asset of the coun
try, and he should imagine that they
could not bo paid out again except by
action of the Assembly, and if any of
those snmsliad been paid to the Japanese.
He would ask what part the Auditor
General took in paying them.
The Attorney-General said he had made
Borne inqurics, but not enough to answer
the question of Hon. Godfrey Rhodes, and
tnat was, as to wnat money- bad" been
paid ont 7 He might safely assume that
none of that fund had been raid back vet.

any such money paid ont it would have
appeared in the account of the Finance
Deparlmenl ; 2nd, tho circumstances un
der which that fund had been deposited
led him to think that none had been paid
out He had been informed by the Mi
nister" of Finance that since his report
more had been paid in.
Continuing, the Attorney General said
that one of the members had asked whether
the Attorney General had authorized the
treasury to receive this money. He was
awaro that it was discussed, but although
ho was not asked for his advice he thought
he might have Eaid that the Government
was at perfect liberty to take it more
than that, there was no reabon for the
Government to excuse itself from taking
it Among tho conditions of the conven
tion with Japan was ono. article 11, of
certain propositions mado by the Japanese
Government Twenty-five per cent of the
wagvs and, other savings of Japanese im
migrants' wero to be deposited with the
Hawaiian Government, at interest of five
per cent A treaty had the same solemni
ty as onv law which the Assemblv mar
pass aud which has the signature of tho
King. When it is asked what right had
the Minister of Finance to receive that
money, ho replies that' it is one of the
privileges of tho convention. If it is
asked what right has this Government, in
tho absence of legislative sanction, it may
be asked what right had this Government
to atrree that Japanese laborers should bo
free from taxes for three years. What
right had this Government, without sanc
tion of the legislative body, to make such
a provision as this to return Japanese
laborers, disabled by sickness or other
reason, without their voluntary consent
Ho said that the action of the Govern
ment was perfectly lecal. This policy had
saved tho Hawaiian Government S7.000 or
$8,000. If they had not been bound to do
it, it would not havo been done. The ar
rangement had to bo carried out till they
had the consent of the Japancso Govern
ment to strike it out When tho Ha
waiian charge d'affaires was hero it was
concluded that the elmiso should be
stricken out, and that tho Japanese Gov
ernment should seek n bank elsewhere. It
could not havo been dono by this Govern
ment a irtc without the' other party,
and when that is done the entire fund
will be taken away, for it has been noth
ing but a trouble. Whether it was proper
to put this item in ho was not prepared to
say, but at any rate it was intended to lay
this matter before the Legislature when it
came to the appropriation under tho loan
Hind.
