Paul street, from a point 60 feet north of Somerset street to a connection with the sewer on Olrasted street, and having investi gated the proposed improvement, Tespcct -1 ally report that said improvement Is neces sary and proper, that the estimated; expense thereof is $i,li!o,one-balf of which need not bo paid into the city treasury before the ! con tract is let; that real estate to be assessed therefor can be found benefited to the extent of the damages, costa and expenses necessary to be incurred thereby; that said improvement Is not asked for by a. petition of a majority of the owners of property to be assessed therefor, bat we herewith send a plan or profile of said improvement, and an order for your adoption, if yon desire us to make the improvement. Referred to Committee oa Public A« counts. REPORT OF BOARD OF FIRE COMMISHOIJERB Fire Alarm Boxes, etc. — To the honorable, the President and Common Council of the City of St. Paul. Gentlkmbk: It has become necessary in the proper discharge of the duties of the Board of the Fire Commissioner, that the Fire De partment have additional fire alarm boxes, to meet the wants of the department, and render it efficient, as the Board are held responsible by the citizens and tax payers, they feel as if there should be no lachea oa their part in making it efficient and reliable. The Bjard therefore have the honor to re quest authority of the Common Council to [.urchaee ten flre alarm boxes. In making request the Board desires it to be understood that they arc most anxious that allthe official, and business relation* between the Board and the Common Council should be pleasant and in accord. That without this friendly feeling the Board in a great measure would be unable to make the Fire Department what It snould be, » credit to the city.^nd to this end the Board will be pleased at all times to bear sug gestions and recommendations from the Com mou Council, whi'e this is true the duties of each are so clearly defined by tbe l»w creating the Board, that they cannot, in the proper dis charge of their duties permit the Common Council to usurp their duties without a pro test at least- The Board confesses to having benn annoyed by the recent action of the Common Council upon one of their requistions for authority to make a purchase for tbe department, and that they might act advisedly in the matter they requested thi opinion of the City Attorney, a copy of which is herewith submitted. Frank Breuer, Esq., President of the board of Fire Commissioners of the City of St. Paul, Dear Sir: In reply to your inquiry as to the power of the Common Council to control th« action of the Fire Commission under the provisions of an act for an act to amend the charter of the city of St. Paul, in. relation to SAINT PAUL DAILY GLOBE FEIDAY MORNING, APBIL 7 1882. the Fire Department of said city, approved Nov. 11, A. D. 1881. I have to say that the duties of the Common Council and the Board of Commissioners are each so clearly defined under the provisions of fcuid act that it is difficult to see how any question or dispute can arise. Section 13, of said act, among other things provides that: "The said board of Fire Com missioners are hereby invested with all the discretionary powers necessary to the faithful execution of the act; including the proper se lection and location of all needful buildings and offices and the complete equipment of the several companies with horsts, engines, ve hicles and other apparatus, and by a two-third vote of all the members of said board shall prescribe, control and regulate the expendi ture of every kind of the department, created by this act " Provided * * * that in case of any proposed expenditure, not including repairs and supplies for the ordinary current use of the department, the enuv shall first be present-d by said Board to the Com mon Counncil for their approval of the same. If said Common Council shall by a two-third vote of all the members thereof approve of the same, it shall be lawful for said Board of Fire Commissioners to Incur or contract such ex penditure, otherwise it shall not bo lawful for said Board so to do." It is evident from the foregoing that In the purchase of supplies for the ordinary current use of the department, or in tne making of nil the necessary repairs, the power of tbe Board is supreme. If the Board of Fire Commissioners, however, desire to make pur chases for the department other than supplies, it is their duty to first present a requisition to the Common Council for their approval, and if the Common Council, by a two-third vote of all tbe members elect, approve of the re quest, the purchase can be made, otherwise tne Board have no authority, but the Common Council have no authority to couple their ap proval with conditions which practicably takes from the Board the power to purchase, for Instance, in a specific case which has been called to my attention. When a Committee of tha Caramon Coun cil reported la favor of giving the Board tae authority to purchase ten fire-alarm boxes, attaching to the authority, however, a condi tion that they must be of a certain patent. The Council, in this case, had they adopted the report, would have exceeded their author ity, their duty was to approve or disapprove of the application— that of the Board — to make the purchase and to buy such boxes as in their judgment are the best and cheapest. The Common Council is the legislative power of the municipality, it designates the amount of revenue to be raised each year, and the uses to which they shall be applied. It was for this reason that the law creating the Board of Fire Commissioners re quires the approval of the Common Council to purchase other than supplies, so that the same shall not be in excese.in any one year, of the funds provided and applicable thereto, and not that a ;ire alarm box should be of certain make or kind,or a horse of a particular color. Theframersof the law very wisely con cluded that those specially charged with the management of the flre department would have a better knowledge of what was wanted than the Common Council, hence the law provided that the Board should make the purchases independent of the |views, or notions of the Common Council. lam led to believe that the action of the Council in relation to purchases by the Board was had without much thought and will be promptly changed upon their attention being called to the matter by the Board. In regard to the purchase of a flre alarm box, for thejnew engine-house upon St. Anth ony hill, It being necessary to the proper fur nishing of the house; which has been ordered the board have authority to make the pur chase without app'lcation to the Couacil. To the Preeident and Members of the Com mon Council: The Commitiee on Ordinances having con sidered the petition of the St. Paul Gas Light Company for leave to erect poles on certain streets, for purposes of an electric light, re spectfuliy report, that as it is the purpose of the council to avoid any monopoly in the use of electric lights In this city, and, a? it is de sirable to afford every facility for free compe tition in tbe furnishing of such lights, both to the city and to private persons, it is inexpedi ent to adopt the resolution prayed for by 6aid Gas Light Company, embracing ull the busi ness distric* of the city m its limits, without some material reservations. An Ordinance to amend section' 2, of Ordin ance No. 261, ''An Ordinance hi relation to the sale of lager beer and malt liquors." The Common Council of the city of St. Paul do ordain as follows: Section 1 . That section 2, of Ordinance No. 261, "an ordinance in relation to tbe sale of lager beer and malt liquors," be and the same is hereby amended so as to read as follows: Sec. 2. No license shall issue for the sale or traffic in spirituous or malt liquors unless the applicant therefor shall file with the City Clerk a written application approved by tho Chief of Pr.lice, and a majority of tbe Com mittee on Licenses of the Common Council, unless otherwise ordered by the Common Council. Be it Resolved, That the St. Fanl Gas Light Company be and it !s hereby permitted to erect poles for stringing wires for electric lighting upon the following named streets in said city, to wit: ' bird street, Fort street, Wabashaw street, Robert street, Jackson street, Sftley 6treet, Wncouta street, Fifth street, Seventh street, Rosabel street and Broadway, under the supervision of and snbjfct to the inspection and control of the City Engineer, and upon and under the fol lowing conditions snd instructions, to-wit: Such poles shall be thirty-five feet in height above the ground, and shall not be less than ten inches in diameter at tbe bottom and six Inches in diameter at the top; they shall be placed, and shall be painted a dark color for the distance of six feet fro«n the ground, and from that point to the top they shall 'be painted white. They shall ta set 140 feet apart, except otherwise expressly permitted by the Ctty Engineer, and In ewe any other corporations, companies or persons are now or shall be at any time hereafter permitted by the Common Cmu9 or said city to erect poles or string its wires for the purpose of electric lighting In said city, or to use the streets of eaid city for the purpose of electric lighting, and such corpwation or corpora tions, company or companies, person or per sons, shall desire to use tbe poles so erected by said St. Paul Gas Light company for tbe pur pose of supporting tbe wires for such pur pose, such corporations, companies or persons shall be entitled to do so upon paying to said St Paul Gas Light • company or its successors, the proportionate fcharo of the co&t of procuring and erecting such poles to be determined^ as follows: Upon tbe erection of poles upon any of said streets said St. Paul Gas Light company shall imme diately report to the City Engineer the actual cost of such poles as erected, and£sid City Engineer shall ascertain and determine the actual cost of said poles so erected, and certify the amount which he shall fled to be correct, and keep a record thereof in his office forpubiic inspection. Upon tbe first appli- cation as aforesaid to use the poles so erected, -. the applicant shall pay the St. Paul Gas Light Company one-half of said actual cost of said poles, so determined by said City Engineer; and in cat« of a second . application the appli- * cant shall pay . one-third of such cost, the ' sime to be divided equally between the . St. Paul Gas Light Company and the first appli cant; and successive applicants shall pay their proportionate share of such cost, the same to be divided proportionately In like manner, and all ' applicants so paying their proportionate share of the cost of said poles shall become and be by common censent joint owners with said St. Paul Gas Light Com pany of said poles, and shall be entitled to use them for the purposes of electric light ing. ; And it is conditioned that If any other i corporations, companies or v persons -shall i procure like permission from caid Com mon Council to erect poles on said streets or . any of them, and shall actually erect its poles on any of said streets before said 1 Bt. Paul Gas Light com pany shall have erected its poles on each street, then the permission hereby granted Is * withdrawn, and said St. Paul Gas Light com pany shall be iv,«tricfed to using such poles then already erected under like conditions as herein contained, and it is expressly condi tioned and provided that la case said St. ; Paul Gs \ Light compaiy shall refuse to allow auy applicant to use its | poles upon payment of the proportionate amount therefor, and to sell to said applicant such proportionate part of said poles as herein provided, thereupon the right of said St. Paul Gas Light Co. to erect and maintain its poles upon the streets of said city shall cease, and the same shall be forthwith removed from such streets or any of them npea and under the order and direction of the Common Coun cil, and it is expressly provided that the ac ceptance of this permission by said St.' Paul Gas Light Co. either by resolution of tbe Board of Directors or by acting hereunder in the erection of its poles, shall be an accep tance of all the conditions and provisions herein contained.and It is further provided that the rights hereby granted are further »übjoct to ail the conditions and requirements of the ordinance heretofore passed allowing said St. Paul Gas Light Co. to use the streets of said city for the erecting of poles for the purpose of electric lighting. He shot 501 in thirty min utes, having missed forty-two. He had ex doubt at the beginning, saying he had never undertaken such a trick. There was a large attendance of spe :t itors.
