Ab ordinance in relation to the erection of public scales in the limits of the city of St. Paul. The Common Council of the city of St. Paul do ordain as follows: Section 1. No person or persons shall hereafter keep or maintain, or allow to be kept or maintained, at any point upon the pub lic streets and within the limits of the city of St. Paul, public 6cale.9 for the weighing of hay, coal, or other articles, without first ob taining a permit therefor as hereinafter pro vided. Sec.2. Ta« ■■■' Cinanoa Cva-iiil of the city of St. Paul may from time to tims auth orize and permit as many, and such persons as it may think proper, to erect, maintain and operate in any of the public streets of said city, scales for the weighing of hay, coal or other articles of any kind or nature what ever, and to revoke the same at its pleasure. Sec. 3. That before any authority or permit shall be granted, the applicant or ap plicants therefor will present to the Common Council an application in writing, setting foith upon what streets and at what points he or they desires to erect such scales. Sec. 4. Said scales must be of the most approved pattern in use-and must be erected under the direction and to the satisfaction of the City Engineer. Sec. 5. That before the authority or per mit of the Common Council to erect any scales as aforesaid shall have any force or eflect, the person or persons j to whom the same may be issued, shall execute a bond to the City of St. Paul in the sum of one thousand dollars, with sureties to be ap proved by the Common Council, conditioned to save the City of St. Paul harmless from all suits, actions, damages, costs and expenses by reason of the occupancy of the street by said scales. Sec. 6. All persons to whom a permit or authority shall be given, shall at all times keep the street around and adjoining said scales in a good, safe and passable condition. Sec. 7. It shall be the duty of the owners or operators of all scales now or hereafter erected in or upon any of.the public streets of said city to have the same adjusted and sealed by the sealer of weights and measures at least once in every three months, and oftener if necessary. Sec. 8. Any owner, operator or weigher of any scales who Ehall give a false certificate, or who shall practice any fraud or deccipt in the weighty hay, coal or other article, or articles weighed, or who shall violate 'any of the provisions of this ordinance, shall, upon conviction, bo fined in auy sum not less than twenty dollars nor more than one hundred dollars Sec. 9. Any person keeping an intelligence or employment olfice as aforesaid who shall directly orindirectly or through aay agent or other person or persons, make use of aay im proper device, deceit, false representation, false pretenses, or any imposition whatsosver for any improper purpose, or for the purpose of obtaining a fee, money, gratuity 'o r other thing of value from any customer or patron or patrons 6hall, on conviction, be fiaed in a 6um not less than twenty dollars nor more than one hundred dollars. The Common Council of the city of St. Paul do ordain as follows: Section 1. That permission is hereby giv en and granted unto W C. Saaith to erect a one-story frame building not to exceed 12x15 feet on the ground, at the Seveu Corners (so called), fronting on Eigle street, at the junc tion of Fort st.-cet, in the city of Bt. No person shall play at ball, or cricket, or throw stones or other missiles in Rice Park, Irvine Park, or any other public park in the city of Saint Paul/and any one violating any of the provision*, of this section shall, upon conviction thereof, be punished by a fine not exc«eding twenty-five dollars for each offense. Sec. 2. No person shall lie upon, or sit upon, or stand upon, or go upon the grass, lawn or turf of any of said parks, unless by the direction of the city authorities, and no person shall cut, ureak, djjface, or in any way injure the trees, shrubs, plants, grass, turf, foun tains, seats, fences, structures, improvements, or ornaments, or property within or upon any of said parks. Any person violating any of the provisions of this section shall, upon conviction thereof, be punished by a line not exceediug fifty dollars for each offense. Sec. 8. No* person shall use, or speak any threatening or abusive, insulting, or indecent language in any of said parks, and no person shall commit iv.any of said parks any obscene, lewd or indecent act, or any nuisance. Any person violating any of the provisions of this section shall, upon conviction thereof, bo punished by a fine not exceeding twenty five dollars for each offense. Sec. 4. No common prostitute Bhall be allowed within, or shall go within any of said parks', and no person Bhall accompany any common prostitute into, or within any of said parks. Any person violating any of the pro visions of this section 6hall, on conviction thereof, be punished by a tine not less than ten, nor more than one hundred dollars. Sec. 5. Whereas, The Common Council of the city of St.Paul heretofore ordered the Board of Pub lic Works to report whether a change of grade on Kent street, from Holly street to Summit avenue, in said cily, as shown by a red line ou a profile annexed to said ordef, was neces sary and-proper, and whether real estate to be assessed for said improvement could be found benefited to the extent of damages and costs to he incurred by said improvement, and, Whereas, Iv accordance Tvith said order the Board of Public Works did make a report to the Common Council of date May 15, 1882, recommending said improvement aad that property could be found benefited to the ex- tent of damages, costs and expenses neces sary to be incurred in making said change of grade as aforesaid, and, Whereas, The Common Council of said city on the 16th day of May 1882, adofiled said report aud ordered the City Clerk to give the notice required by law, and, Whereas, The City Clerk gave notice in the official paper of said city, for three suc cessive weeks, twice in each week, that the Common Council of said city would, on the 20th day of June, ISB2, at 7:30 o'clock p. m., at the Council Chamber in said city, consider suck proposed change of grade, and, Whereas, At the time and place desig nated for such proposed change of grade, the Common Council, after hearing all persons in terested, and being of the opinion that the same was necessary and proper, ordered the grade of Kent street, from Holly to Summit avenue, to be changed in accordance with the red live as shown on the annexed profile, being the same as referred to in all the proceedings had iv regard to said change; therefore, Resolved, That said order and the profile rep resenting said change of grade be referred to the Board of Public Works, and that said Board shall proceed without delay to assess the amount as nearly as they can ascertain the same, which shall be required to pay the dam ages, costs and expenses of such improvement upon the real estate to be benefited by said im provement, as provided by law.
