Now, (U nothing taxes tbe skill and all ttaepow- W( crs of a lawyer like the conduct of a jury 0f case, with its every varying interest, its cu changeful vicissitudes, and its unexpected ?0 phenomena. In at least half of the crimi^ nal cases where direct proof of guilt is wanting, the verdict depends mainlv on the efforts of counsel for the defence, but elo^ quence is a small part of tho matter, and taken by itself, is rather dangerous, except ac in a closing appeal,. None but a man of a^ the highest forensic ability is capable of _.^ simulating enthusiasm, and yet remaining ^ cool, collected, guarded and acute at the j; same time. Frantic appeals about honor, j mourning wives, weeping babes, blasted QT reputation, ^c, are comparatively useless. ?s The memory of them is obliterated, when s0 necessary, by a few plain, yet forcible re^ marks from the preceding counsel, and turned unfavorable for the prisoner, by a | jn word from the judge's lips. Cross-exami- _a nation is the forte of your aeute advocate, and a masterly Bumming up of the results 0i; obtained crowns the keystone of his arch of^ Triumph. Frequently the cause is de^ cided ere the witness leaves the Btand.
We remember a case in which Mr. War- ~L ren was engaged, when the court, the . plaintiffs and ths defendants were com- . pletely thunderstruck by a forensic coup dc Cl. main of this nature. One of those intri- W1 cate and unfathomable will cases was being c* hotly contested. The plaintiff sought to ? upset a will, on the ground of its being a forgery; but the skillfulnesB of the plot, ou the apparrcnt candor of tho witnesses, the 8.e unpretending appearance of tho widowed 1C plaintiff, carried all before them, and Follott the invincible, smiled blandly in the pros- pect of assur .d victory. At the conclusion J of the evidence for the plaintiff, while the , leaders were consulting whether it would f not be better to make terms and submit, r?
