The case stands ast preCsnt as follows: About the middle of December, Judge Trnett, under au thority of the United States act, made appli cation to the land oAcesa for the entry of fve fo.rty-acre lots, and three fractione of forty acre lots. comprising in all come three hun dred and ten acres of land, as a town site. The land asked extends from near the aeme on Grizaly iulch down nearly to Taylor, Thopsonu .t (o.'. claim, and embraces that portion of Last Chance and Dry lalches ly ing between lines drawn at nearly right an gles with the Gulches at those points, except one forty-acre lot between Fifth Avenue and thep sk:ting park, for which application has been made as agricultural land. It covers all other improved portions of the town. Evidence will be taken on both sidae in writing, sworn to before the lend oices, and trensmitted to Commissioner Wilson, who will decide upon the merits of the case. We think that the proposal to guarantee the miners in their rights was made in a sparit of equity and good will; and, while holding that they are right in protecting their interests, believe their rejection of the profered bond was, if not inconsiderate, at least misjudged. The entry of the town site of Helena, enabllng property owners to secure (iovernment title to their lots, would materially appreciate its value, and those adverse claims, if snstained, will debar the entry. It is to the interest of lot owners to be present at the hearing this morning, that the evidence sent to the Com missioner may not be ex parts from lack of attentlnn on the part of lot owners, or the inability of the Probate Judge to secure evi dence.
