TOWNSHIPAND HIS*HAT, PLATS.
Thehrst authentic reconl of real prop^^erty commences with the government sur^^vey of townships and mining claims and^the pUU thereof. The uw should provide^for a certified copy of till these plats in each^count), to be keot in the county clerk's of^tic.-, and tor an Index sheet or plat of each^township in the county on a convenient^acale, showing the relative location of all^milling claims. Tin1 certified copies ot^plats should he added to as last as new sur^^veys are made and approved
Inunsurveyed townships there are at^present many surveyed mining claim*^whose location is reterred n^ an iuitial^point, which is unconnected with the pub^^lic land surveys. In order that these claims^may he properly located iu the townships^In which they In-long, the county surveyor^should run the neresiary connecting lines^and til** a put of such survey with the^county clerk, the survey to he made at the^expense ot the county.
mIN Kit a 1. locations.
Thelaw relating to the location and rc^cording of mining claims could he greatly^improved. At present the discoverer stakes^out liis claim roughly on the ground, gen^^erally by pacing the distance between his^stakes, and is then required to post a ^lo^^cation notice^ and to Die a copy thereof in^the county clerk's office. The notice s^ts^forth, that be has discovered a lode or ledge^of silver bearing rock, which he h is chris^^tened the ^Ituby lode:^ that said lode is^situated in the ^Ten Mile Mining district.^^and that he claims as surf ace ground :*00^feet in width on each side of the lode and^1,500 feet in length along the lisle, aud that^he has set the necessary stakes at the cor^ners of his claim The township and^range,that such mining claim is sttuat^ d in^are not given, nor is any mention^made of adverse claims to the^^tame surface ground. It often happens^that the same ground Is covered wholly or^in part by several locations Parties mak^^ing a subsequent location mav dispose of^their interest by a quit claim deed, in which^the description ot the claim is a copy of the^location notice. When a mineral loeation^becomes valuable it is impossible to make^a correct abstract of title and the purchaser^of such a claim can not tell how many ad^^verse claimants may appear when he ap^plies for a patent.
Itis frequently the case that there are^Ml eral locations of lodes under the same^name in the same mining district th.ercby^adding to the confudnn in ttie records^I In Colorado the law requires asurvey to^)^ made at the time of loeation, and a plat^^ such survev showing all contl ounfl^uiuis to be riled with the county re^^corder.
Thiswould be a great improvement, and^while it would entail an additional expense^on the discoverer, it establishes ch-urly the^boundaries and location of his claim ami^lessens his chances ot becoming involved^In costly litigation in the future. At the^same time the Increased cost would pre^^vent the riling of worthless locations, taken^Up With the hope ot bUekinnililig - mii^ id^joining claimant, or of obtaining a small^piece of agricultural land as ininer.il Off tor^the limber on the land. Such locations^are not unfrcquently made, simply because^It does not cost any thing to locate a mining^claim and once located opportunities are^not wanting to dispose of it to others.
I'latsof mineral locations should be^filed in the county clerk'sofficeand marked^location survey No. ^ In the proper town^^ship and range. When the claim is official^^ly surveyed and the plat tln-rvot is re^^ceived the clerk should write across the^face of the location plat. In red ink, the^number of the mineral survey aud lot num^^ber of the township and range.
Sucha law should provide for a location^survey of all future discoveries, and also^that the transfer of any claim, located^prior to the passage of the act, should not^be recorded until a location plat thereof^was tiled in the county clerk's office.
INDKXINOTltANSKNJts AND LIST OF PHOP-^KKTY.
Thepresent system of Indexing transfers^of real estate is good eno *gu so far as it^goes, but it is almost tink^*sit^le to find^from the records the owneraMp of any par^^ticular piece of land.
Thelaw for the assessnH^t of taxes^passed last winter provides tha. the clerk^shall make out and turn over to the county^assessor, on the 1st day of February of each^y ^ ar. a list of all the taxable property in ttie^county, but as these honks are iu the hands^of the assessor, while he Is making the as^^sessment, and after that In the county^treasurer's office, they are not readily ac^^cessible. The assessment is made ou the^Individual owning the property and the list^Is srranged alohabeitrally. so that theown^ershipof any particular piece can only be^found by hsiking through the list. Besides,^tips list only contains the taxable property^and is not a complete Index to all lands^transferred and claimed in the county. The^clerk should keep another Index book,show^^ing all transfers and the ownership of each^piece of real property. Kach township^should be Indexed separately, commencing^with s. own 1 and giving each section iu^Its order. Then all surveyed mining^Claims in the township should be listed tu^the order of tbeir lot numbers, and follow^^ing these should be a list of all unsurveyed^mining claims that can tie located in the^proper township. In unsurveyed town^^ships all agricultural claims should be^listed. This index book should show the^date of each transfer and the grantee's and^itrantor's names and should have suffl dent^I lank space to allow for at least ten trans^^fers on each piece of property. These^books could be started from the best Infor^^mation at the clerk's disposal and they^would not interfere with any abstract^books in the county, as H would be Imprac^^ticable to make a complete record back of^the year in which they were opened.
Fromthis index book the clerk would^find It an easy matter to make up the as^^sessment books each year. This book could
alsobe arranged to show all delinquent^taxes and all sales for taxes.
PLATSOK LANDS.
Insome states it Is customary to have^plats made of all the property In the coun^^ty, on which the ownership of each tract Is^mark..i in pencil, but this is hardly needed^In Montana at the present time, although a^law, which allowed the clerk to have such^plats matte as were necessary to ascertain^if all the land In any section was correctly^assessed and described, would be advtsahK
InMinnesota the county auditor, who^l^erfortns * many of the duties of the^county clerk in this territory, has the^authority where property is badly cut^up and transferred by mete ami^bound descriptions, to order the same to he^platted and thereafter the different pieces^are described on the tax list as lots No. 1,^I 8, etc , of Auditor's sub-division No. ^.^There are over forty of these auditor's sub^divisions now platted in Hennepin county.^The cost of such platting is assessed as a^tax on the property.
PLATS OP TOWNSITKS AND ADDITIONS.
Whilemany of the plats of townsitesand^additions on file In the different counties^are passably good, others are extremely^bad and hardly one Is perfect. The law is^very tone* in its wording and requirements.^The most common errors are in the forms^of certificates. Many of the plats contain^errors of omission and some even It would^be difficult to locate In theterrltory of Mon^^tana.
[ The law should state plainly the form of^^ rtiticate to be used by the surveyor and^by the parties owning the land, by which^they dedicate the streets and alleys to the^public use. usunlly known as the ^dedica^^tion certificate.1' Kach p'at should show^plainly the ground intended to be platted,^which should also be described In the ded^^ication certificate. All dimensions of every^lot should he plainly marked on the plat;^also the w idth of all streets and alleys and^the distances and courses of the exterior^boundaries; also all angle*. Kach plat^should he carefully inspected by the^county clerk before he receives it for rec^^ord, and it should be his duly to refuse to^record any plat that is not complete, ac^cording to law The surveyor should set^at least two monuments on evt ry street,^which should be correctly located on the^plat.
Incities the plats of additions should^first lie submitted to the city engineer, who^should examine them carefully and certify^that |hei conform to the adjoining add ^^tionsand parts ot the town already platted^They should ttien be approved by the city^council and the city clerk should certify to^Mich approval. The last two certificates^should be on the plat before It Is received^tor re- tird by the county clerk. The plats^tiled for record should theii he copied in a^plat book of a convenient size tor the public^use, and the originals should he deposited^in tin-clerk's safe aud only referred toby

plat. As the plats are now kept it would^he an easy matter for any person, were he^so disposed, to make erasures and changes^on the originals, or to carry any pint hway^from tin* office and destroy it
Thelaw should provide for a sufficient^fee for fYcording the plat in the manner^suggested.
KOADPLATS.
Therecord of the roads in the territory is^very incomplete. A law was once passed^making all traveled roads legal highways^but not providing for their survey. This^law has since been repealed, so that only a^few of the road* now traveled are legal,^and the only record existing is of new^roads opened in the last few years. The^county commissioners should be required^to have surveys insdn and legal roads es^^tablished throughout each county and a^plat of each mad entered in the plat-book^provided for that purpose. The above^suggestions are submitted in the hope that^(he society may present such of them as^meet with its approval, to the present ses^^sion of the legislature and that some of 111'^most needed amendm nts to ttie present^Ihw may be enacted at an early date.
