THEDAILY IXDEPENDEJf'l: HELENA. SATURDAY MORNING. .TUNE 8, 1880. HEBE'SA MESS. JudgeBlake Renders a Decision^Which Will Be of More Than^Passing Interest AWoman Not a Person in the Eyes^of the uaw Unless Made so^by Legislation. t ^otar^ hMk or .^ liol^l^lit-j^tit^ ^ oustaMe. Idthe district court yesterday morniDft^Judge Blake deliver^ an opinion. wlii'h,^aaide from the o,ue^tion^ involved in the^case decided. uilBht be regarded aa one of^aeriou* iiui^ortane*-. IM |uestioc decided,^and to which the derision has particular^reference, 18 that a f. male cannot act a.- a^deputy conatable: but the laDUun,^- of the^decision would logically and inf^r^ntially^lrad to tt.e conclusion that a f^-rualt- cannot^act in any official capacity, unleag t-xpreg.-ly^authoru-d so to do by legislative enact^menu In the light of this daemon the^.,uc^tion arisen, notarial commiwiiocs Iwing^issued to wonn-n in Ihil territory, whether^or not their acU axe a nullity. This -jues-^tion was not ilrterruincd in the case de^^cided, but the languagf ot .fudge Blake is^exuri-saive enough to warrant such a con^^clusion. The decision referred to la aa^follow a:. . ^Inthe matter of the garnishment pr^e^ceedinga ariaing in the caae of King A^Nuaa againat Mra. Malioy. This waa an^action brought in the justice's court, and u.lgmentwas obtained by King A Nusa^against Mrs. Matter, and Ifca Northern I'a-^cific Railroad company waa garnisheed.^It appeals that an order had been pre^^viously gueu by Mrs. Malioy to pay a oer^tain corporation the money which she was^entitled to receive from the railroad com^^pany. There is one question, which was^not raised by counsel, that confronted me at^the outaet. which 1 have iuv^ stigateit lather^carefully, because the question haa never^been raised in this territory before. 1 hnd^three notices of garnishment, winch ap^pear to tie regular in form, hearing tac^superscription, ^* iflice of the Constable ot^Lewis and Clarke county,^ and aigmd.^^^Klla Knowlea, special Constable.^ I find^that the execution is directed by the justice^of the peace to the sheriff or an\ '^^ Bete^file of said county, and a return is made^by Klla Knowlea to the effect that she^haa received these papers and served them,^and Miss Knowlea haa testified upon the^witness stand that shrf did do this. Now, 1^have no hesitation in aaying that under^the iawa of this territory, while a justice ot^the peace baa the power conferred by a^statute to appoint a person to act aa a^special constable, be cannot appoint a^female er a woman to do thai week, and^^ hilt. in defining the qualifications of ^^t-^ti-er-^ in Una territory, there is no restric^^tion aa to ai x, at the aame time the decis^^ions are uniform: and 1 refer particularly^to a case in the 131 Mass. lieports, the^cvse of l.elia.i. Kobinson. iii which the^opinion was delivered by Chief Justice^Gray, now one of the judges of the su^^preme court of the I'uited Mates, in which^the authorities are carefully reviewed, and^it is there held that when a statute, in de^lining the qualifications, ot a person to hold^office, does not specify sex, it^is always understood that persons^of ttie male sex are referred^to. and that a female cannot hold any^office unless the statute in so many words^says that she can. And it is tor this reason^when women have applied to be licensed^as attorneys and eouuaeiors at law in sev^^eral of the states^Illinois, Wisconsin and^some others^that their applications have^been refused^that an attorney wa- an^officer of the court, and the legislature^must control that matter. In this territory^there is no restriction as to sex. In defin^^ing the qualifications of attorneys and^counsellors at law, the atatutcsays per^^sona, yet the legialatuie seemed to take^this view of the matter, and at the laataes-^sion, in order that females might lie per^^mitted to practice law in the territory, a^law was passed which allowed persons to^practice law regardless of sex. 1 am there^^fore clearly of the opinion that Miss^Knowlea bad no right whatever to serve^these writs of garnishment, and the pro^^ceedings resulting therefrom were utierly^null and void, and the serving ot them b^^her does not in any way affect the raiiraod^corporation or any of the parlies to this^suit. thenew election law NewI'm tarts Named and Begioirar- and^l -. ^ t^- ^ Appointed. Thecounty commissioners have been^busy for several days fixing up registra^^tion districts, naming the registry agents^end fixing the polling placet under the^new law known as the Australian system^of voting. The new law will require a^large increase in the number of jugdes ar,d^consequently will prove a much greater^expense to the county. It was found nec^^essary to divide Helena into fourteen pre^^cincts, aa the law requires that there ahall^be a voting precinct for every 400 votes or^leas. Mary av ille is also divided into pre^^cincts, which make forty-one in the^^^ounty. requiring 1*^1 judges of election.^There axe hve judges each in the Helena^precincts, ten int Marysville: five in East^Helena, rive in Kessler'g and three each in^the outside precincts, which remain the^-ame as last year. Thereare ten registration prectnets in^the county, the law fixing the limit at^'wenty. The commissioners used their^judgment and set ten as the number, divid^^ed as follows: FirstFirst, second and third wards ot^Helena, I'nionville and i'ark. econd^Fourth, fifth, sixth and seventh^wards of Helena. Goodwin and Valley. ThirdKessler's Mouth of Nelson and^liutler: place of registration, K^ssler's. Fourth-East Helena. French Bar and^Spokane: place of r-gistration. East Hele^^na. Theplaces of registration in Helena will^t^- left to the registering officers, who will^^ -eive twenty-five cents per capita, not to^-xceed -5 per day. The registrars will be^-worn in August 1, and remain in session^from August 15 to .September 15^thirty^days. The judges of election and registrars^have all been named. peterJACKSON.
