if any person ahall hereafter incite, set

or insurrection against Ihn anthoril v of

shall civo aid or comfort thereto. or shall
enpa;;o in, or give aid and comfort to, any
such existing rebellion or insurrection,
and lie eonviclcd thereof, ouch person

ments, at the discretion of. the court.

ces described in this act shall be forever
incapable and disqualified to hold any
otlice under the United States.
Sec. 4. Ami I it furtlvr tnudol. That
Ibis act xhall not be construed in any
way to a fleet or altar the prosecution,
conviction, or puiiinhiucii( of any perron
or persons guilty of treason as-ainst the
United Slates before the pa-a::e of this
act, unless such person is coiii lcd un
der this act.
Sec. 6. Anillie it in thtr aun!-l, That,
to ensure the speedy termination of the
present rebellion, it shall be, the duty of
the President of the United Slates to
cause the seizure of nil the estate and
property, money, stocks, credits, and ef
fects of the persons hereinafter named
in this section, and to ftppiy and use llie
same and the proceeds thereof for the
support of the army of the I nited States
that is to say : ,
First. Of any person hereafter acliiie;
as an officer ef the army or navy of Ihe
rebels in array against the (Iovernment
of Ihe United States. ..
Secondly. Of any person hereafter act
ing as President! .Vicc-rfr.sidcnt, mem
ber of Congress, judge of any court, cab
inet officer,' foreign minister, commis
sioner or consul of the so-called Con fed.
crate .States of America. ......
Thirdly. Of any person actios: as
Governor of a tate. member. of. n, CoQr
venlion or LeKisJaturc, or judge of any
conrt of anyof (fjev aollcoji&'.jeal'e
States of America.
Fourthly. Of any person who, having
held an otlice of honor, trust or pi fit in
the United States, shall hereafter hold an
office in Ihe so-called Confederate States
of America. '
Fifthly. (l any person hereafter hold
inp; an office or agency under the so-called
Confederate States of America, or un
der any of the several States of the said
Confederacy, or the. laws thereof, whe
ther such office or agency lie national,
Htale, or municipal in its name or char
acter: PiwiiM, Thai Ihe persons thirdly,
fourthly and fifthly alove described
shall have accepted their appointment or
election since the date of the pretended
ordinance of secession of the State, or
shall have taken an oath of allegiance to,
or to support tho Constitution of, the so
called Confederate Slates.
Sixthly. Of any person who, owning
property in any loyal State or 'territory
of the United Mates, or in the l'islrictrif
Columbia, shall hereafter assist and rive
aid and comfort to such rebellion; arid all
sales, transfers, or conveyance's of any
such property shall be null and void; 'and
it shall bo a sufficient bar to any suit
brought by stlch jkmsou for the possession
or use of such property, or Any of it, to
allege and prove that he is one of the per-
sons described in this section.

and abet such rebellion, and re I urn to In
allegiance to the I'nited Slid s, all the
estate and properly, moneys, slocks and
