Sec. :. Ami If it f'ffhrr enceed, That j
every person (cuilty of either of the oun
ces described in this ad shall be forever
incapable and disu:ililied to hob any
ollice under the United Slates.
Sec. 4. And U it further funded, Thnt
thin ad shall not be construed in any
way to ad'ed or altar the prosecution,
conviction, or punishment of any person
or persons guilty of treason against the
United State" before the passage of this
act, unless such person is convieled un
der this ad.
Sec. o. -'"itf it further emietid, That,
to ensure t.fr speedy termination of ihe
present rebellion, it shall be the duly of
the President of the United States to
cause the seizure, of all the estate and
property, money, stocks, credits, and ef
fects of the persons hereinafter named
in this section, and to appiy and use the
same and the proceeds thereof fur the
support of the army of Ihe United Stales;
that is to say :
l'irst. Of any person hereafter atlin".

rebels in an ay apainst Ihe (iovcrnment
(he United States.
Secondly. Of any person hereafter act
ing us President, Vice-President, mem
ber of Congress, judge of nny court, cab
iucl ollicer, foreign minister, commis
sioner or consul of the so-called Uonfcd
rrate States of America.
Thirdly. Of any person acting us
(lovernorof : State, member of a Con
vention or Legislature, or judge of any
court of any of the so-called ( 'onl'ederatc
Slates of America.
r'oiirthlv. Of any person who, having
held an ollice of honor, trust or pi lit in
Ihe United Stales, shall hereafter hold an
ollice in the so-called Confederate Stales
of America.
I' il'lbly. Ot any person hereafter hold
ing an ollice or agency under the so-eail -ed
Confederate Stales of America, or un
der any of the several Stales of the said
Confederacy, or the laws thereof, whe
ther such ollice or agency be national,
state, or municipal in its name or char
acter : I'roridcd, That the persons thirdly,
fourthly and liflhly above described
shall have accepted their appointment or
election since the date of the pretended
ordinance of secession of the Slate, or
shall have taken an oath of allegiance lo,
or to support the Constitution of, (he so
called Confederate Stales.
Sixthly. Of any person who, owning
property in any loyal Slate or Tcrrilory
of the United Stales, or in the Uistricl of
Columbia, shall hereafter assist mid give
aid and comfort to such rebellion; and all
sales, transfers, or conveyances of any
such projieity shall be null and void; and
it shall be a sulllcicnl bar to any suit
brought by such person for Ihe possession
or use of such property, or any of it, to
allege and prove that he is one of the per
sons described in this section.
Sec. (!. Ami lie it further enacted, That if
any person within any Stale or Territo
ry of the United States other than those
named as aforesaid, after the passage of
this act, being eugai-ed in armed rebel
lion against the (iovcrnment of the Unit
ed Slates, or aiding or abetting such re
bellion, shall not, within sixty days after
public, warning and proclamation duly
tiiveu and made by the President id' the
United Slates, cease lo aid, countenance,
and abet such rebellion, and return to bis
allegiance lo the l ulled States, nil the
estate and properly, moneys, stocks and
credits of such prison shall be liable to
seizure as aforesaid, anil il shall be Ihe
duty ol the President to seize unit use
them as aforesaid, or Ihe proceeds there
of. And all sales, tianslcrs or convey
ances of any such properly after Ihe ex
piration of the said sixty days from the
jate of such warning ami proclamation,
shall be null and void: and it shall be a
sufficient bar to any suit brought by such
person for the possession or the use of
such properly, or any of il, to allege and
prove that he is one of the persons de
scribed in this section.

ceedings in rem shall be instituted in
the name of the United States in any
district court thereof, or in any Territo

within which the properly above descri
bed, or any pari 'hereof, may be found,

lirt t be brought, w hich proceedings shall
conform SS nearly as may be to proceed -inn

thereto, escaping from such persons and

persons or dscrled by them and coming
under the control of the ( iovcrnment of
the United Males, and all slaves of such
persons found on for being within any
place occupied by rebel forces snd af
terwards occupied by the forces of the
United Stales, shall be deemed captives
of war, and shall be forever free of
their servitude, nrnl not again held as
slaves.
Sec. I". And!- it further tnne.te.1. That
no slave escaping into any State, Terri
tory or the District of Columbia, from any
other Stale, shall be delivered up, or in
any way impeded or hindered of his lib
erty, except for crime, or some offense
against the laws, unless the person claim
ing said fugitives shall fust make oath
that the person to whom the labor or ser
vile of such lugitive is alleged to be due
is his lawful owner, and has not. bonus
arms against the Uniled States in the
present rebcll.ou. nor in any way given
aid and comfort thereto; and no person
engaged in the military or naval service
of the Uniled Stales shall, under any
Jirdriice whatever, assume lo decide on
the validity of the claim of any person lo
Ihe service or labor of any other person,
or surrender up any such person lo the
claimant, on pain of being dismissed from
the service."
Sec. 1. And If it J'nrllvr eiinded, Thai

thorized to employ as many persons of
African descent as he may diem necessa
ry, ami proper for the suppression of this
rebellion, nnd for this purpose he may or
ganize and use them in such manner us
he may .judge best for the public wel
fare. See. And l,e it fiirth-r eumted, That
the Prestdcnt. of the United Slates is
hereby authorized to make provision for
Ihe transportation, colonization, and set
tlement, in some tropical country beyond
the limits of the United Stales, of such
persons of African race, made free by the
provisions of this net; as may be willing
to emigrate, having lirst obtained thu con
sent of the (iovernnietit of Said country
to their protection and oetlleineiit within
the same, w ilh all the rights and privi
leges of freemen.
Sec. I:). And it further r untied. That
the President is hereby authorized, at
any time hereafter, by proclamation, to
extend to persons who may have partici
pated in the existing rebellion in any
Slate orpartthereof, pardon and amnesty,
w ith such exceptions and at such time
and on such conditions as he may deem
expedient for (he public welfare.
Sec. 11. And 1 it fnrllyr enacted, Thai
the courts of the United States shall have
power to institute proceedings, make or
ders and decrees, issue process, and do
all other things necessary to carry this
act into effect.

as not lo apply lo any act or acts done
prior to the passage thereof, nor to in
clude an v member of a Slate Legislature
or Judge of any State Court, who has not
in accepting or entering upon his ollice,
taken an oat h lo support the Const i I ul ion
of the so-called 'Confederate States of
America." nor shall any punishment or
proceedings under said act be so con
strued as to work a forfeiture of the real
estate of the oU'ender, beyond his natural
life.
