The Court met at the usual hour, Msjor General Gillern presiding, Mr. llngt Recalled on Ooi examination: If I had received mules from Mr. Hender son on the 6 h of August, and he bd not called tne receipts t:li the 7th, it would have been dated back. The accused here asked that if during the examination ia the Bruner trial, the itness didn't state that h gave Mr. Hen derson a false receipt f r 522,000 or 23,0u0 in the csrly jart of Auu-t. The accused replied that he was impeaching the wittcas, and therefore he had a rijhl to ask the question. The Court Cleared, a'ol the objection was sustained. Colooel Coyle for the occured then asked: Did vou no', on the ilruner tria', a tale that the mules we e reported on the day they Here received? The Judge Ad voce te desired that the wit nes ru:ght be allowed to refresh his mem ory by examining his testimony in tha Bruner trial. Col. Coyle objected, and the Judge Ad vocate thcu stated that he would object to theqestio n, unles the witness was allowed to examine tho record to tell what be did s:y. Col. Coyle fcaid heAbad bo reply to make to this. Objection overruled. 1 cannot state positively whether I said this on the Bruner trial, for I don't recollect if any such question was put to me. I can't say certaia what day I went on duty in the corrals; I cannot state positively whether or not it was on the ih of July. After referring to the corral books, he said that he fjULd the first entries in his hand writing on the 7th day of July; but he thought, from appearances, that several leaves were missing out of the book, s there were lo entries between the 7th and Uth. He afterwards said bethought the first entry was made on the 9.h instead of the 7th, as the book was not perfect. I had, however, worked tor Mr. Brucer on a former occasion. I did not state yes terday that there was a mark by which I could ascertain that the receipt for ninety mules was a false one. There was no dil lcrence in the record of a false and a true receipt. If I had made any marks to dis tinguish them detection would have fol lowed. There is nothing in the corral bok to show where false receipts were given. I cannot say exactly when Mr. Hender son asked me to give him false receipts, hut 1 think it was about the time I went to the corrals, in July, 18(54. I was on duty in the corrals, also in 1853. Col. Coyle here asked if hehad not signed false receipts in 18C3, to which the Judge Advocate objected. Objection overruled. Col. Coyle next askcu if witness did not, in 103, make propositions to H. C. Middle ton, to swindle the government. (Objected to by Judge Advocate. Objec tion sustained.) Col. Coyle next asked: To whom did you fir t tell Ibis sto'y about Mr. Henderwou? (Objected to by Judge Advocate. Objec tion sustained.) Vrots examination continued. I gave my evidence for the prosecution under promi ses and threats. tu'stiou by Cd. Coyle demanded that the witness should produce a certain paper in his pos session, promising imperfect immunity for punishment, in case curtain things were accomplished. Objected to by Judge Advocate. Col. Coyle replied that ie intended to ehowthepirom.be to be a frauiulent one, and therefore it sff.cttd his credibility. Objections of Judge Advocate susUined. Col. Coyle here retd the following: The accused here stales that tome time since, when Iloge was passing through Louisville, after his lirst arrest, sxid Hoge wrote him a letter threatening to implicate him (Hen derson) in frauds at Nashville, becsuse he did not go his (Urge's) bail lor $5,000on the day bef re. The accused further elates that such letter was destroyed, the accused well knowing that such charges would be groundless, and thinking nothing would come of it. He desires to prove the con tents by Mr. Hoge himself The accused unders'ood that a copy of the letter is in the hands of the government, and asks that it may be given bun. The Judge Advocate replied that it would take a little time to hunt it up, but it would be produced when found. Mr. H-'ge continued: This letter was written at tbo suggestion of of Capt. Voris, the Jmlgo Advocate- He did not tell me I might have ali the money I could make out of it, but it was the intention to turn it over to the Government. I did not tell Mr Bru ner that I was to have the money I could get from Mr. Henderson; nor did I use bis name without authority. Col. Coyle asked : Did not you tell Major Blackmail that Captain Voris, after the Bru ner trial, told you that you didn't swear worth a cent ? Objected to by JuJge Advocato Voris as illegitimate. Co1. Mr. Hender son handed me the money, as if ho had prepared it all ready for me. In our notice of James Wood the other day, we stated that he killed himself on account of a fit of jealousy. This statement was uade us by several parties, who, we supposed, were well informed upon the subject; but his relatives state that such is not the case, and they are of opinion that he shot himself ac cidently, not knowing that his pistol was loaded. ' - The bill to pay John Erricaon f 13,930 for services in plannicg the war steamer Princeton, was called up and passed. The bill to reimburse Western Virginia for ner expenses in calling out and equipping the troops, was called up by Van Winkle. The amount called for is $303,000. Washington May 3. House Mr. Bout well, from the liecons true tion Committee, reported the testimony in relerence to the Slate of Georgia. Mr. Conkliu reported in reference to Vir ginia and North and South Carclina. Laid on the table. Mr. Julian offered a resolution, which was adopted, requesting the President to communicate any information he has con cerning the discrimination made by Maxi milian in regard to commerce from particu lar American ports. The House proceeded to the consideration of report of Committee on Territories. Mr. Ashley, from that Committee, report ed a substitute for House bill to amend the act of May 26, 1864, providing a temporary government for West Virginia. The 1st lection authorizes the government to reap portion the territory. The 2d section annus all acts of the so-called legislative assembly which met in the city of Virginia on March 5, 1866, and forbids the payment of money to members thereof. The substi tute was agreed to, and the bill as amended passed. Mr. Ashley also reported back Senate bill passed March 14, enlarging the boundaries of the State of Nevada, by including a part of Utah and Arizona. Mr. Ashley reported an amendment, pro viding that the rights of citizens to mineral lands in the territory added shall remain as valid, substituting "mining claims." The amendment was agreed to. Mr. Bice offered an amendment to strike out that part adding a portion of Arizona. In response to a question by Mr. Hooper, Mr. Ashley stated that the bill took from Utah one degree east and west, leaving Utah still 8,SoO square miles, instead of 10, 000. Mr. Hooper, of Utah, opposed the bill on the grounds that the transfer of people from one government to another reduced them to mere seris. Ho therefore entered his pro test against tho bill. Mr. Goodman, of Arizona, opposed that part of the bill affecting Arizona. Mr. Ashley said that Brigham Young told him last summer that he had no objection to the proposed dismemberment of Utah, as there were but few, if any, people living in that portion. Mr. Ashley supported the bill, and said the Mormons were averse to dismember ment; that the citizens of Nevada had dis covered and were making wine in Utah and didjuot wish to be under control of that Ter ritorial Government. The amendment offered by Mr. Price was rejected, and the bill passed. The bill to admit Colorado into the Union was taken from the table, aud the House re fused by a vote of 29 to la to lay it on the table again, and refused to commit it by a vote of 04 tj 74.
