United States Attorney Wise appenred
before Judges I.acombe, Word nnd Xovcb,
BittinR as tho United Stntea Cottrt of
Appeals, yesterday to rnnke application
for an extension of the time allotted to
tho Government for the presentation of
its case in the dissolution suit against the
American HiiRnr HcRning Company.
Mr. wise stated positively that the
Government could not ooncludo its case
in lens than 100 days. James M Heck,
counsel for the suar people, said that
lio had no objection to an extension of
time, but considered that tho defence
was entitled to an equal period of Rrnco
riie court reserved decision.
Attorney Wise in support of his motion
for an extension of time said that judg
ing by tho present stutus of tho case the
hearings before Special Exnminer Wilson
II. Hnce could not be concluded in lesi
than three months at the very least. He
said that tho court had originally granted
the Government sixty days for tho pres
entation of its caso and thirty daj'B for
rebuttal. Much of this time, according
to Mr. Wise, was taken up by the hear
ings at Denver, San Francisco and Salt
Lake City, whore tho defence had ample
opportunity lor cross-examining, wit
nesses. Tho United States Attorney was in
terrupted toward the end of l;is appeal
iy a commotion in tne court room.
Delangnel Berrier, one of the spectators
seated in tho jury box, had fallen V) tho
.floor in an epileptic fit. So Vera I of thu
court attendants and lawyers rushed to
the man's assistance nnd for 11 time there
was considerable excitement. Marshal
Henkol had Homer removed to tho
marshal's office on the door below, where

Mr. Heck said he would havo to consult
with the legal advisers of three tir four
HUlmidiary corporations located in dis
tant cities, In addition to this he said
that there weie between twenty-six and
twenty-eight separate sugar manufac
turing corporiatons to be examined, sev
eiul of which were hostile to thu Ameri
can Sugar Hefining Company.
At 2:30 o'clock yesterday afternoon tho
hearing before Special l.xaminer Hrice
was reopened. After an hour or so con
sumed in tho taking of statistical testi
mony an adjournment was taken until

Naval Court of Inquiry on tho accident to
the destroyer Waiko will contain, it is said,
stories of great heroism on the part of both
officers and men of the destroyer in their
efforts to save their oomrados, A num
ber, it is expected, will l rewarded with
medals and commendation from tiio Navy
Department.
Oiler F. H. Conway will bo 0110 of the
men rewarded. He tied oily waite over
his facn as a protection from the lient
and went into tho engine room with a

deck. Conway also assisted in getting
tho other men out. The identity of tho
