HOTOHKISS RIDDLES
COMPENSATION BILL
Calls Glynn Measure Socialistic,
Costly and Mciihcc t
Stule'ri Interest.
LIE ON ITS FACE, HE SAYS
Half the Workmen Exempt, He
Points Out. Though Other
States Include All.
William II. HotchtilH.-. es-Slntc Sup.
rlntemlcnt of Insurance, who In oppos
ing the paxKiiKe of Hie workmen' com
pensation "III favored ti" !ov. Olynn.
said yesterday ono of hlH reasons Is thnl
"wo I'roRresNlvca feet It our duty to
trlke at Micliillem wherever It appears."
"t am very Rind." ho wilil. "that Clov.
Glynn has hroiiKht to public attention
my iipponltlon tu his lilll, It In not a
ecret opposition, lut was lit rt rxpicwoil
In a memorandum, whli'li I left with lilm
over a week uko. In which I mild ; 'It
would lie better to postpone tin- enact
ment of a workmen' compensation law
rattier tlian to consent to .. .millions In
Midi law which would make. It a lie on
ltd fare."
"That l Just what, from tho stand
point of t-oiinil public policy and fair
workmen's compensation legislation, l!ov
(ilynu's bill will be at least mi f.ir as
I have been informed as to Its tcints.
"I note that thu i.ovcrnor apparently
refers to urn In a statement In which he
peaks of the ITosrcsalvc party. lie
ought to know that we Progressives feel
It our duty to strike at socialism wher
nvtr It appears. This Is one reason why
T oppose his bill. It is only slightly less
socialistic than the workmen's compen
sation law of Ohio.
Calls provisions HeTolntlnnar?.
"It seems Inconceivable to me that Oov.
Olynn, whoso declared policy thus far Is
a contcrvatlve one, can favor, among
other provisions, those which, llrst, pro
hibit employer and employee from nuk
ing agreements as to wanes, which, after
injury, are to be paid in the form of
oinpcnsatlon ; second, as shall make the
State tho distributing paymaster of such
wnces, thus puttlntr government In be
tween tho employer and the cmploce:
and, third, as shall deny to the employer
the rlRht which he has always hitherto
had of nn appeal to the courts. These
provisions aro all socialistic and. In my
Judgment, revolutionary It Is, therefore,
my duty, as a I 'regressive, to light any
bill which contains such provisions.
"It Is also my duty, as counsel for
several employers' liability companies,
and mieakltiK from an active experience as
a supervisor of Insurance, to point out
as I have dune and shall continue to clo
the serious Insurance defects In i!ov,
Olynn'a proposal. The people of New York
have voted for such a law as will put an
end to negligence suits and ambulance
chasing; yet, ns I am Informed, cjov.
illynn'B bill will be so phrased as to leave
employers who do not Insure In the State
fund and who are charged with wilful
fault or failure to observe safety appliance
laws liable to u suit for damages and to
the predatory action of negligence lawyers.
Fears for State's Interest.
"Further, what can lie said of a measure
which shall put the Stale Into the linui
ance, business and yet give the work
men's compensation commission ftc iin
as to reserves and latcs'.' I'ortunutely, tile
hill will declare that the State treasury
Is not to bo responsible, but if this commis
sion makes mistakes in Its rates and there
Is a deficit as there has been elsewhere
what of the moral obligation of the State,
thanks to Oov. (ilynn's bill"
"Tin- ilovernor reminds me that 'the
people ttrst to be eonsldeied m the framing
of this bill are the labor Interests." I agree
wllh him. but only up to tho point and
I again use his mvn words, printed on
November T, 1 v 1 3 that In framing such
bill, the same shall not be so devised as
to 'confiscate the Interests of the em
ployer.' "Does Oov Olynn Lliou that the
schedules In this bill will make compete
nation cost th employ cis of New York
moio than twice, and perhaps three times,
na much as It now eots the employers of
-Massachusetts, Ithode Island, Connecticut
and New Jersey, all neighboring manu
facturing States, more, even, than the
socialistic law of Ohio costs them, and s.'
per cent more than it costs them In
Michigan "
"I repeat. Oov Olynn Is entlrh right In
saying that the people llrst to be con
sUered In the framing of such a bill are
the laboring people but his bill In
exempting the non-hazardous trades,
exempts more than half of the laboring
people of tho JVnte. I am for Including
them all. So is the Association of I.abot
legislation.
"Does the Governor not know that this
has been done without protest from the
labor people or without endangering the
constitutionality of the statute. In eighteen
of the twenty-two States which have work
