Despite threats by the police to a'rest Overy conductor who refuses to carry a detective or plainclothes man fare free while the officer is in the performance of his dluty, ord ers issued by Manager Wharton to his employes to compel all but policemen and firemen in uniform to pay fares remains in full force and effect. Mlanager Wharton yesterday received a communication from the state public service commission up holding himn in his contention. In its letter of yesterday the commission cites atuthority to show that its o;rders relative to the conduct of public service utilities supersede and take procedure over any city ordinances of regulatory nature in the matter of such public utilities. Recently Police Lieut. Alike Dwyer placed a conductor under arrest when the latter refused to carry the officer to the depot to apprehend a suspected criminal, free of fare. Individuals to Start Suit for Damages If Phones Removed. Because of the fact that hundreds of telephone users in the city are having their phones removed rather than pay the advanced rates which went into effect on the first of the month, thereby seriously interferring w-ith the business of local merchants, the chamber of commerce has taken steps toward compelling the phone company to reduce its rates to the old figures. The determination on the part of the chamber of commerce to enter in a light for lower telephone rates was made yesterday at a meeting of the municipal affairs committee of the organization. At the meeting it was pointed out that since the higher rates had become effective, hundreds of private families accustomed to transmitting their orders to grocery and other stores by phone had dis continued their telephones. This, it was pointed out, not only means that the stores must continue to main tain their telephones at higher rates. but must also revert to the old and more costly system of employing so licitors. The chamber of commerce com mittee, it was announced, admits that the telephone company is entitled to an increase over the old rates, but maintains that an increase as at pres ent, ranging from 33 1-3 to 85 per cent is unreasonable. It is declared a movement is on foot among a number of business en terprises using phones extensively to refuse to pay the increase over their old rates, on the grounds that their contracts with the Mountain States Telephone' and Telegraph company call for service at the old figures. In event the telephone company discon tinues service on such phones or re moves the instruments, it is said, suit will be started against the telephone company for breach of contract and for resultant damages to the plain tiffs' businesses. It was announced that a confer ence would be sought with Manager Owens of the telephone company today by the chamber of commerce committee. However, since Manager Owens has no authority to reduce the rates, it is expected that the matter will have to await the decision of the company's officers in New York.
