Washington, May 10.A novel, not to say, alarming condition of affairs ex ists on the St. Johns river, the stream which flows thru Maine and New Bruns wick into St. Lawrence river. The Can adian government is threatening to feend men into Maine to cut out log booms, which it claims are obstructing the navigation of the river. The threat is one of invasion if there ever was one. The threat was regarded so seriously that Secretary Taft asked Hugh O'Beime, the charge at the British em bassy, to call on him today. Taft told him about the obstreperousness of the Canadian government, and asked him to get Lord Lansdowne to advise the anadians to do nothing until after Sen ator Hale has had ate opportunity to get his bill passed submitting the question in dispute as to navigation of that river to a joint commission for settle ment. COMElIN 'H''' The Canadians assert that the log "booms divert the waters of the river to such an extent that its navigability is seriously impaired, and at times wholly destroyed. The Americans im pound the waters for the purpose of floating logs and in that way deprive the Canadians of the quantity of water they believe they would have in the New Brunswick part of the stream were the logs removed. The Canadians for several years have been trying to get the question referred to the ioint commission appointed five or six years ago for tho purpose of con sidering questions growing out of the navigation of the Great Lakes, and the "streams in the watershed of the St. Lawrence river." That is the language of the law, but the Americates contend that the purpose of the law was to have commissioners consider merely the effect that a dam at the head of Lake Erie would have upon the harbors of the two countries. Washington, May 10.Secretary Taft fairly took the breath out of the 300 railway men, members of the Interna tional railway congress, dining last night as the guests of the American Railway association, when, after be ing introduced as "the apostle from the Philippines," he emphatically de clared that railway-rate legislation must come that if the railway men of the country were wise they would aid and not hinder it that the sentiment of the country is such that failure of fhe iroper regulation meant a campaign on subject that would do no good to the railroads. Absolute silence reigned as Secretary Taft spoko his mind on the subject of rates. He was positively against gov ernment ownership, he said, believing that nothing so deleterious could come to the country as this solution of the question. Not Like Private Business. "But," he continued, "you cannot run railroads as you run private busi ness. You must respond to the public demand. If there is danger of dis crimination, then you must allow the establishment of some tribunal that will remedy that discrimination." President Stuyvesant Pish of the American Railway association had in troduced Secretary Taft. In his ca pacity as toastmaster Mr. Pish was on his feet the instant the secretary concluded. He answered the secretary at length, taking the view that the law to prevent discrimination, double dealing and secret rebates was ample, and he vigorously called for the en forcement of that law. Mr. Pish talked of the vested rights of the money tied up in railways. He apologized lor allowing himself to be diverted, and as he sat down Secretary Taft, who sat next to him, queried in a low tone, "May I have fifteen min utes to reply?" This time was given and the secretary utilized it making himself even more positive as to his position in favor of legislation which would create a tribunal with authority to name a maximum late. What Plan Means. "The law now is," continued the sec retary, "as decided by the supreme court of the United States, that first a commission and then the courts may decide whether a particular rate is rea sonable or unreasonable. Now, in fixing that, in the very mental process in de termining whether a rate is reasonable or unreasonable, one has got to fix what is a maximum rate. As I understand it, what is proposed is only that in liti gated cases a commission shall be con stituted that shall fix a maximum rate in other words, to go through the same process it now goes through to deter mine what is a reasonable rate. What I am strongly in favor of, tho, is that we shall have a body that shall decide things, and that those things shall be decided within a reasonable time, finally by the courts." Third Floor. The only phase of the railway ques tion which will come before the congress is that of "slow freight rates," which topic will be presented to the general session of the congress Thursday. The conclusion reached by the section hav ing it in charge is that "tariffs should be based on commercial principles, tak ing into account the special conditions which bear on the commercial value of the services rendered. With the reser vation that rates shall be charged with out arbitrary discrimination to all shippers alike under like conditions, the making of the rates should, as far as possible, have all the elasticity neces sary to permit the development of the traffic and to produce the greatest re sults to the public and to the railroads themselves.'' On the question of length of time on duty and working regulation for em ployees and laborers, section four of the congress reached the following conclu sion for presentation to the general ses sion of the congress: "That due to the many peculiarities of railway service, it is impossible to reconcile the rigidity of the law with the elasticity necessitated by the va rious requirements by the needs of the public, the employees and employing management.
