ment." At the time the constitu
tion was written,- the initiative
and referendum 'hadn't been
heard of, so of course, they
couldn't be included' in what the
constitution meant by a "repub
lican form of government."
Chief Justice White in his
opinion says that it is up to con
gress' to 'say wtiat constitutes a
"republican, form of govern
ment," and that the judiciary has
nothing to do with it.
He also pointed out that what
the telephone company had done
was to haul the state of Oregon
up before the supreme court on a
question of the state of Oregon's
right to legislate as a state. .
