CUNNEA HAS HARD TIME
The petition of Wm. F. Cun
nea, Socialist candidate for state's
attorney at the November elec
tion, for a recount of the vote, is
still searching for a judge to hear
Cunnea filed his petition before
Circuit Judge Tuthill. Maclay
Hoyne, Democratic candidate de
clared elected on the face of the
returns, filed a demurrer, attack
ing the jurisdiction of the circuit
court. Judge Tuthill decided

Tuthill was not the proper person
to hear the petition, as he had
worked for Lewis Riiiaker, Re
publican candidate, in the cam
paign. 'Rinaker's vote would have
to be counted with that of Hoyne

sent to Judge Gibbons by Judge
Tuthill and now rests on his dock
er. Judge Gibbons, however, an
nounced he would not hear argu
ments on the petition.
Hoyne wants the suit heard
before County Judge Owens. If
the circuit court judges refuse to
sit on the case it will probably go
to Owens or be dropped .
