4. Mo pay will be made for trip not performed ; and far
each or such omissions, not satisfactorily explained thre

and not nifficitntly excused, one-fourth of th compensation
for th trip is subject to forfeiture, for repeated delinquen
cies of the kind herein specified, enlarged penalties, propor
tioned to the nature thereof and the importance of th mail

6. For leaving behind or throwing eft the mails, er any por
tion of them, for the admission of passengers, er for being
concerned in setting up or running an express conveying in
telligence in advance of the mail, a quarter's psy may bs
deducted.
6. Fines will be imposed, unless the delinquency be promptly
and satisfactorily explained by certificate of postmaster or
the affidavit of other credible persons, lor failing to arrivs in
oontraet time: fir neglecting to take the mail from, or deliver
it into, a post office; for suffering it to be wet, injured, des
troyed, robbed, or lost; and for refusing, after demand, to
convey the mail aa frequently aa ths contractor rues, or is
concerned in running, a coach, car, or steamboat on a rente.
7. The Postmaster General may annul ths contrsct for re
peated failures to run agreeably to contract ; for violating ths
post office laws, or disobeying the instructions of ths depart
ment ; for refusing to discharge a carrier whn required by ths
department to do so; for running an express ss aforesaid ; or
for transporting persons cr packages conveying mailable mat
ter out of the mail.
8. The Postmaster General may order an increase of service
on a route by allowing therefor a pro rata increase on the
contract pay. He may change schedules of departures and
arrivals in all eases, and particularly to make them conform
to connections with railroads, without increase of pay, provi
ded the running time be not abridged, lie may also order an
Increase of apeed, allowing, within the restriction of th law,
a pro rati increase of pay for the additional stock or carrier,
if any. The contractor may, however, in iAs eato cincrtaao
of optod, relinquish the contract, by giving prompt notice to
the department that he prefer doing so to carrying th order
into effect. The Postmaster General may also discontinue or
curtail th service, in whole or in part, in order to place on
the route a greater degree of service, or whenever the public
interest, in his Judgment, shall require such Jiscontinuanc
or curtailment for any other cause; he allowing as a full in
demnity to contractor one month's extra pay on toe amount
of service diapenaed with, and a pro rata compensation for
the amount of service retained and continued.
t. Payments will be made by collections from or drafts en
postmasters, or otherwise, after the expiration of each quar
tersay, in November, February, May, and August.
10. The distances are gieen according to th beat information;
but no increased pay will be allowed should they be greater
than advertised, if th point to be supplied are correctly
stated. Bidder must inform ttienuelv on iki point, and
alio In relerence to the weight of the mail, th condition of
roads, hill, streams, Ac, and ail toll bridges, ferries, or
obstruction of any kind by which expenses may be incurred.
No claim for additional pay, based on such ground, can be
considered ; nor for alleged mistakes or misapprehension a to
the degree of service ; nor for bridges destroyed, ferries dis
continued, r other obstruction increaain; distance, occur
ring during the contract term. Offices established after this
advertisement is issued, and also during the contract term,
are to be visited without extra pay, if the distance be no
increased.
11. Bidders are cautioned to mail tkeir proposals in time to
reach the department by the day and hour named, (S p. a.,
March 29, 1866;) for bids received after that time wU not bo
considered in competition with a bid of reasonable amount
received in time. Neither can bids be considered which are
without the guarantee required by law and a certificate of th
sufficiency of such guarantee.
12. Bidders should first propose fyr srvic strictly accord
ing to the advertisement, and then, if they desire, parou't for
different service ; snd if the reyuiar Lid be the lowest oQered
for the advertised service, the other proposition, may be con
sidered. 13. There should be but one rocte bid for iu a proposal.
Consolidated or combination bids (" proposing on sum for
two or more routes ") arc forbidden by law, and cannot be con
sidered. 14. The rout, the service, the yearly pay, th nam and
residence of the bidder, (that is, his usual post office address.)
and thoee of each member of a firm where a company offers,

' 15. Bidder, are requested to use, as far as practicable, the
printed proposal furnished by the dpartment, to write out
! in full th sum of their bids, and to retain copies of them.
I Altered bids should not be submitted ; nor should bids one
submitted be withdrawn. No withdrawal of a bidder or guar
antor.will bo allowed unless the. withdrawal is dated and re
solved before the. last day for receiving proposals.
Each bid must be guarranteed by twu refpousilile persons.
The bid and guarantee should be VQi plainly with the full
name of each person.
The department reserTes the right to reject any bid which
may be deemed extravagant, and also to disregard the bids ef
fulling contractors and bidders.
16. The bids should be sealed, superscribed "Mail Proposals,
State of Tennessee, " addressed "tteeond Assistant Postmas
ter Ueneral, Contract Offlc,".and sent by mad, not byor to sn
agent; and postmasters will not enclose proposal (or letters
of any kind) in their quarterly returns.
17. The contracts are to be executed and returned to the de
partment by or before the lacrfdy of July, 1S)6 ; but the serTire
must be begun on that day, or on the mail diiy next after it,
whether the contracts be executed or not.
Transfers of contracts, or of interest in contracts, are for
bidden by law, and consequently cannot be allowed. Bidders
will therefore take notice that they will be expected to per
form thr service accepted to theni through the whole term of
the contract.
IS. Postmaster at office on or near railroads on which
mails are carried, but more than eighty rods from a station,
will, immediately after the Tith of April, 18W5, report their
exact distance from the nearest atation, and how they ar oth
erwise supplied with the mail, to enable the Postmaster Gene
ral to direct a mail-meengr supply from the lt of July
next.
19. Section eighteen of an act of Congress approved March
3, l(o, provides that contracts for the transportation of tb
mail shall tie let, " in every cae, to ths lowest bidder tending
sufficient guarantees for faithful performance, without other
reference to the niudo of such transportation than may be ne
cessary to proTide for the due celerity, certainty, and security
of such transportation." I'nder this law, bids that propos
to transport the mails with " celeri If, certainly, and mem-Uy,"
having been deeideH to be the only legiii bidt, are eonttrned as proci

20. A modification of a bid in any of its essential terms i
tantamount to a new bid, and cannot be received, so as to in
terfere with regular competition, after th last hour set for re
ceiving bid. Making a new bid, with gnarantee and certifi
cate, is the only wsy to modify a previous bid.
21. Postmasters ar to be careful not to eertify th sufficien
cy of gnarantore or sureties without knowing that they are
persons of sufficiert responsibility : dieregard of Ai intlrnc
lion by poetmastrrt it a xiulation of thevr oath of offr, tubject
iny then to immediate remoeal. All bidder, guarantors, and
sureties are distinctly notified that on a failure to enter int'i
or perform the contract for the service proposed for in th
accepted bids, their legal liat'ilities will b enforced against
them.
iZ. Present contractors, and persons known at the depart
ment, must, equally with others, procure guarantor and cer
tificates of their sufficiency substantially in the forms above
prescribed. The certificate of sufficiency must be signed by
postmaster, or by a judi of a court of record. No other will
be admitted. Theeertiticate must also haTpaflixed to it a five
cent revenue stamp, cancelled, as required bv law.
