DR. BAGBY ACQUITTED.
The mayor of the city lias acquitted
Health Officer John R. Bagby of the
charge of malfeasance in office during
the first days of the yellow fever s a e.
This decision of the mayor will pro?
voke considerable criticism, especially
among those who have net heard the
evidence adduced at the investigation.
This investigation was impartial, and
as thorough as it was possible for His
Honor to make it. He exhausted the
means at. his command to secure evi?
dence.
That there was not as much evidence
as His Honor had a right to expect af?
ter the men: lM'hle scene on the first
Tuesday night in August, is a fact,
and one for which the mayor is not
responsible. Hie advertised for evi?
dence, 'which never cane-. He summ n
ed scores of witnesses who never re?
sponded. His Honor was bound, in
reason, to conclude that tin- evidence
advertised for did not exist and that
the witnesses summoned did not know
any tiling.
Notwithstanding the failures alluded
to above, quite a large bitch of witnes?
ses did testify. Tin- evidence of every
one .if these witnesses was in accord
with the admissions ol the defense.
Tin- defense admitted that passes
were issued in comparatively large
numbers; 'but contended that they were
usued under the authority of the Bear.!
of Health?authority particular and
specific, down in black and while for
the occasion.
The defense admitted that a fee was
charged in many instances for passes;
hut claimed that this fee was for cler?
ical work?a recompense for additional
labor, not unusual among health offi?
cers.
The evidence introduced by the city
simply and (merely substantiated these
claims: nothing more, n;.'. hing less.
The defense, while admitting that it
might have been a mistake, under the
circumstances and at that tima, held
emphatically that ther ? was neither
corrupt intent nor corrupt action.
This contention was also proven.
Tile mayor, acting' in a judicial ca?
pacity, could have rendered no other
decision.
The investigation was not held for
the purpose of passing upon Dr. 'Bag
by's qualifications :is health officer.
This is a question that should have
'been settled when he was selected by
the council. It is a question that
should enter into the selection of all of?
ficers of the city at the time of their
selection. In this way mtiny mistakes
would be avoided and much that should
not happen would never happen.
But the .mayor was n it passing upon
Dr. Bagby's qualification.-. The ques?
tion which he had to settle was wheth?
er Dr. Bagby, 'between certain dales,
committed a certain offense.
The equanimity with which French?
