WHAT D1ESTHE1EW YEAR CQHTMN?
Wall Street Hopes That It Will Hold
a Solution for the Demoralized Con- i
dltlon of the Market?The Closing
Quotations.
(By Associated Press)
NEW YOKE. Dec. 30?The eventful
financial year drew towards Its close
with activity In stocks today under
the restraint of seasonable elrcum
[ stances. Call money rates went high?
er, but tho advance was not so vlo
lent ns had been feared. The extent
lot the actual culling of loans seemed
to ho small.
A complicating factor in the money
market was the notice from <ho sec?
retary of the treasury to the national
banks in New York that they would
be expected to pay over 10 per cent,
of the government deposits held in
daily Installments covering the next
ten days.
There is a growth of confidence in
the rate of improvement in the
money situation which Is to be ex?
pected after New Year. Tho action
of tho day's call loan market gave
some feeliug of assurance that even
the temporary needs of the. yearly
settlements might be passed without
notable disturbance of tho money
rate.
An incident of the day was some
increased offerings of fuads In the
tlm? monoy market, although the In?
crease was not sufficient to alter ma?
terially the almost dormant state of
that department. Tho day's gains
were fully retained at tho closing.

?HOT, THAW'S PLEA
No lore "Unwritten Law" In the
Trial Beginning Next Monday.
EVELYN WILL TAKE STAND AGAIN
Woman with the Child's face will be
the Storm Center for Several
Weeks to Come?State's Direct Case
VAU be Brief.
NEW YOBiK, Dec. 30.?Next Mon?
day Harry K. Thaw will be called a
second time for trial on the charge
of murdering Stanford White. Thaw
and his attorneys are still preparing
wbllo the District Attorney's case Is
ready for presentation.
Mrs. Will lam Thaw, mother of the
probably be one of the first arrivals
Saturday. Mrs. Thaw has been In
poor health, it Is said, but believes
Bite can be present. Other.-; members
of the family. Including Mts. George
Carnegie, Harry Thaw's sister, and
Joslnh and Edward Thaw, his broth?
ers, are expected this week. The
Countess of Yarmouth Is In Englnnd
and Is not expected to attend the
trial. Mrs. Evelyn NesbLt Thnw will
probably be one of tho first nrrlvols
In tho courtroom on Monday next,
and Is expected again to tell her
story to the Jury.
In the coming trial, It is declared,
there will be no mention of unwrit?
ten law, but the defense will adhere
strictly to n plea of legal Insanity?
a defect of reason which left Thaw
Incapable of knowing the nature or
quality of his act or that the act was
wrong. Such a defect, under tho
New York statutes, excuses the com?
mission of an otherwise criminal act.
Evelyn Thnw again will bo the
storm cestur of the trial, It has been
predicted, and next In importance
will be the alienists who will testify
as to Thaw's mental state.
The State's direct case will bo
brlof. It will have added to It tho
extendeu testimony of James Clinch
Smith, Ibrothor-ln-daw of Stanford)
.White who talked with Thaw the
night of the tragedy,
j Without Evelyn Thaw's testimony]
It would be difficult for the defense
to predicate a plea of Insanity. At
tho first trial the entlro structure of
mental derangement rested upon the
story of her alleged mistreatment nt
the hands of Stanford White, told
by her to Thaw one night in Paris
when ho hod asked her to become
his wife. It was afterward Thaw
wrote the queer letters which were
Introduced in evidence; mado his
will, with Its provision of a fund for,
the punishment of persons responsi-1
bei for vice;went, to his home In
Pittsburg and acted so strangely that
his mother was alarmed, and shot
nnd killed the man his wife hnd ac?
cused. WithouL Evelyn Nesblt's
story ns the moving cause, for the
insanity which spent its fury In tho
denth of Stanford White Thaw's
plea for Immunity from punishment
would have little left to stand upon.
Martin W. Littleton, or Brooklyn,
who nominated Alton B. Parker for
President at the last Democratic Na
llont) Convention, will act as leading
counsel. Ho will have the . assist?
ance of Daniel O'Reilly and A. .Rus?
sell Poabody. both of whom went
through the first trial. O'Reilly Is
111 with Abe grip, but will probably
be well again when the trial starts.
