And a Merchant of This City Finds Himself in a ttathor Unenvi able Predicament. Phoenix has a well, n sensation. It created quite n breeze upon tho streets, too, late yesterday afternoon, when it became noised about, rather guardedly, that ono of the large mer chants, and a well-known citizen, had run a tilt with tho Grand Jury and got worsted. Ever sinco it was cmpanneled on Monday, the Jury has been at work be hind closed doors and from out tho se cret chamber there havo floated dark hints of transactions that wero to thrill the people of tho entire city. The peoplo will, very probably, bo duly thrilled. Yesterday the Grand Jury came into Court and, through tho Foreman, in formed Judge Kibby that they wero ready to submit a partial report. The Jury was given the right of way, as is customary in such cases, and tho fore man handed up two indictments. Tho first of these was against William Hibburd, upon a chargo of carrying liquor upon tho Whito Mountain Indian Keservation. Hibburd has already been held to an swer upon preliminary oxamination.and is now on bail. He will lo arrested at once. The second indictment was different. It was a joint affair, carrying with it tho anticipated sensation, and, upon looking at it, Judge Kibby fixed the bail of ono of tho indicted parties at $500 ami oi me otner at ifiw. jMinuii warrants wero directed is sued, and, within fifteen minutes. Harry Bernard, tho proprietor of tho "City of Paris" storo, and Svlveria Zu- nica had been brought into court to an swer a charge of unlawful cohabitation. Bernard is a well-known merchant of Pha-nix, and tho woman is a not overly young or very protty niticlo of femi ninity. Bernard, it appears from tho cae that it is alleged to havo lcen made out against him lioforo the Grand Jury, has been keeping the woman in a room at tho rear of his store for about nine months past. lie came hero from Tcmpe, where he formerly kept storo and where lie had separated from his wife some little time ago, and tho woman Sylveria appeared hero at about the same time. Since that time the officers claim that the couplo havo lwen living together, and tho complaint has been lodged againt them under tho provisions of tho Edmunds act intended for tl prcssion of lKilygamv. "It is not," said a court officer to a reporter of The Kei'uiilican yesterday, "the intention to mako the provisions of this act burdensome, but this was a flagrant cao and we were compelled to tako cognizance of it on behalf of the morals of the community.', Both Bernard and the woman gave bail yesterday, and were released. California Wild Horset, Three bands of wild horses roam tho plains east of Lancaster, says tho Ante lopo Valley Timet. Whence they came, how long they have thus roamed, or the exact number of them, no ono seems to know. Several horses and colts have been captured from thc-e bands each spring for a number of years. Last j ear one man caught three colts that had lieen separated from the band by the train toward Rosamund. Tho entertainment that was to have Wen given on tho evening of tho 23d, at tho Opera House, has been post poned till Tuesday, May 27, on which date a very entertaining programmo will lie given. This will bo for the benefit of the McMullin Building Fund, to ena blo tho trustees to complete the bnilding which was begun last winter. Many ot tho sweetest local singers will partici pate, and tho instrumental music will bo particularly fine, including selections by Miss May Rickerson, Mr. M. AV. Harris, of San Francisco, and Prof. Herman of Denver. Messrs. Case, Tomlinson and others will givo recitations. There seems to be a disposition on tho port of a few politicians in Arizona to persistently push forward the claims of tho Territory for statehood. Tho tax payers do not ask for tho admission of Arizona as a State; the population and taxable w ealth of tho Territory do not warrant it, and by assuming tho re sponsibilities of State governmont.titxes already heavy, will bo greatly increased, and nothing gained. Capital will not imest where tho tax rate is heavy ; and we all know that tho levy in this Terri tory "could not stand much of a raise." The lesson taught by Nevada should bo heeded by tho State-making apostles of Arizona. The additional cost to the tax payers by playing at State government would 1)0 at tho lowest possible notch ifl2."i,000 per annum. And in return what would bo received? Nothing, ab solutely nothing, unless we count a long list of new and useless office holders, as being of some value. On the other hand, the liberal expenditures made by the national government in our behalf would bo withdrawn; our credit which now stands first class.would be lowered ; immigrants would hesitate about set tling in a country which would be truly in an experimental condition, and capi tal carefully steer clear from the dan gers and uncertainties attendant upon a section assuming burdens it could not near. Tho times and conditions are not now favorable to Statehood; in a few years Arizona will bo prepared for tho cases cases, Score first blood for the Territorial administration. Agreeable to his announced intention Judgo Kibby, in tho District court yes terday delivered his opinion upon the point raised by the defence in the so- called Asylum cases, as to whether Superintendent Titus and Secretary of tho Asylum Board Alexander wero of ficers or merely employes. The deci sion, ol course. Included tho same point raised in the caso against Behan, Superintendent of the Territorial Prison. These cases were brought, it will be remembered, by tho Territory uion the relation of the Attorney-General, to se cure possession of offices alleged to have been usurped by defendants, who de murred, mainly upon the ground that the places held were employments terminable at the will and pleasure onlj of tho employers, the Prison and Asy lum Boards, and not public offices. In his decision yesterday, Judgo Kibby decided that tho positions held were offices within tho meaning of tho law, the incunilients drawing pay from and being responsible to tho Territory, and not merely employments. Suddenly a steel splinter from the edge of a chisel struck his left eye, burying itself in the eyeball to such a depth that Doctor Munson, to whose office tho unfortunate man was removed, was unable to ex tract it with a forceps. AVitli the assist ance of Doctor Van Allen a successful operation was performed. A powerful magnet was applied to tho wound and a splinter of steel one-sixteenth of an inch in width and three-eights of nn inch in length was drawn out.
