The first enso yesterday in tlio Dis
trict Court was tliat o( tho Territory vs.
1'rieilimto Ruiz, accused of aggravated
It developed from tho testimony that
one Dougheney and his w ifo Julia had
liad a falling out and separated. They
had n common property in tho West
End hotel in this city. During tho ab
sence of tho wife an attachment for $2000
was put upon tho property by Prieiliano
Ruiz, the defendant. This attachment
was by tho wife claimed to bo void, al
leging that no consideration had passed,
and that Ruiz was merely serving her
husband against her interests. She
thereupon filed n homestead upon the
property. She also took steps toward
obtaining possession of tho home. This
she did by strategy on March 17, ami
when Ruiz tried to enter tlioy had
trouble. It was charged that Kuiz laid
violent hands upon Mrs. Dougheney
and threw her dow n stairs. On tho side
of the defense it was stated that they
both rolled to the bottom of tho flight.
Mrs. Dougheney, However, managed to
hold tho fort.
The jury finally reported, loto in tho
evening, that it couldn't possibly agree
upon erdict, and was discharged.
