A MERGER OF CANALS
IN BUCKEYE COUNTRY
THE BUCKEYE COMPANY TAKES
OVER THE WHITE TANKS.
Th Consummation of a Deal ..Which
Was Begun Last May.
The consummation was effected
yesterday of a deal wbjeh wan begun
last May and which will le of great
value to the Buckeye country, the
taking over by the Buckeye Irriga
tion company of the property of the
White Tanks Canal company. Ac
cording to the terms of the deal the
former, which had an authorized cap
ital stock of IC.OOii shares of the par
value of $10 each was to deposit with
the Union Bank and Trust company
as trustee, 4.000 shares for sale, seventy-five
per centi of the proceeds
to go to the White Tanks company
and twenty-five per cent to the Buck
eye Irrigation company. The latter
had already issued and disposed of
12.000 shares. The others had not
then been issued but they have been
since and they are now in the pos
session of the trustee. At the tine
of depositing them Secretary C. M.

are likely to prove deleterious
to health.
Zander of the White Tanks company
released mortgages on about 10,000
acres of land under that canal.
These mortgages, though not bur
densome, had to a large extent pre
vented the lands from participating In
the real estate activity which the oth
er parts of the Buckeye country had
enjoyed. There were seventy of the
mortgages. The secretary also exe
cuted a deed transferring all of the
property of the White Tanks company
to the Buckeye company. The legal
business for the two companies was
transacted by Ernest W. Lewis for
the Buckeye company and Walter
Bennett for the White Tanks com
pany. The White Tanks company grew
out of the dissatisfaction withNcveral
farmers in that !art of the country
with the management of the Wessex
company, the owners of the Buckeye
canal. It had no capital to begin
with. It is stated that the only thing
in the treasury at the outset was a
fat hrg. Three days' collections add
ed $2:;oo. The $:in,000 which will be
received by the members of the com
pany if the trustee's -stock should be
sold at par.
The property transferred consists of
a heading in the Salt river above the
head of the Buckeye canal and about
three and a half miles of construc
tion work in which 200,000 yards of
earth have been excavated. This
work is not yet finished but it is prob
able that it will be completed and
made a part of the Buckeye system.
A year ago last February the inter
ests of, the Wessex company were
taken over by the farmers in that
neighborhood for $93,000, of which
$16,000 was to be the first payment,
the other payments to be made $8,000
a year. There is yet due $66,000.

proclaimed and do hereby proclaim
Thursday, the 26th day of November,
1908. as Thanksgiving Day. I. Joseph
as Thanksgiving Day In the territory
of Arizona, and recommend its cele
bration accordingly.

Justice Johnstone Fails to Finish an
Interesting Story.
Richard Smith was up liefore Jus
tice Johnstone yesterday charged with
ridmg a bicycle on the sidewalk.
"If this man had not offered the
officer a dollar to let him go," ex
plained Marshal Moore to the justice,
"1. might have been dismissed with
an admonition."
"There are altogether too many of
these attempts to bribe public offi
cials," said Justice Johnstone, eyeing
the prisoner. "Why, just the other
day a man came around here with
a hundred dollar bill say, is that a
newspaper man over there in the cor
ner T'
When assured that it was the jus
tice said: "Well, I'll finish that story
some other time. Smith, you are
fined $3.00."
Smith said in extenuation that the
place where he was riding his wheel.
Seventh and Washington, used to le

acquired the habit of riding on the
sidewalk.

street between Second and Third.

wealthy stockman, was this morning ;
found guilty by a jury in the federal I
court of maintaining a fence in which I
was enclosed 112.000 acres of govern- I
ment land in this county, of which
25, ("00 acres are vacant. The case
lasted a week and was hotly contest
ed, the defendant being represented
by Attorneys Welsh, Miller and Suth
erland, and ihe government by United
States District Attorney Lawlor. The
trial was especially interesting be
cause of the fact that Attorney Law
lor sprang a sensation when he In
troduced evidence to prove that Mills
had perpetrated wholesale frauds five
yearstago by employing fifty men to
make bogus land entries so that Lil
lis could acquire control over a vast
acreage. It was proved that Lillis
sought to keep persons from entering
upon government lands enclosed by
his,, fence. His punishment may le
a year In jail or a fine of $1,000. Lil-
