Far rell, his successors and assigns, a privilege to cumber the houses of the City of Albuquerque, New .Mexico: Je It ordained by the City Council of the City of Albuquerque, New Mex ico: Section 1. The right to number all the liouses of the City of Albuquerque, fronting on the public streets, avenues i and thoroughfares within the City of Albuquerque, shall be and is hereby granted to E. M. Farrell, his success ors and assigns, for the period of five years, from and after the approval thereof, for the purpose of numbering and maintaining numbers upon all the houses in the City of Albuquerque, and upon any houses that may hereafter be erected. Sec. 2. And the privileges granted tieieln are upon the express condi tion that the work of numbering the houses shall begin within thirty days from the passage of this ordinance, and continue until the houses in the city are numbered, and provided also, that the numbering of all houses shall 1 be done as prescribed in Chapter XI. II, Compiled Ordinances of the City of Albuquerque of 1905. . Sec. 3. It is understood that the granting of this franchise shall in no way conflict with the rights of prop erty owners, who may think proper, to number their own houses, so long aa they do not conflict with the plans and regulation laid down In ordinances now In force in the City of Albuquer que. Sec. 4. The said E. M. Farrell, his successors and assigns, shall furnish to the City of Albuquerque, free of charge, good and substantial street signs, to, be put up and maintained upon at least one corner of each cross ing of all streets and avenues, said signs to be placed as the Street Com mittee may direct. Sec. 5. .This ordinance shall take effect and be In force from and after 1U passage, approval and publication, and the grantee shall pay the cost of said publication. .Duly passed this 6th day of Novem ber, 1905. Sec. 2. That the city marshal be nnd hereby Is ordered to notify the owners of the said abutting property, or if they be non-residents of the city of Albuquerque, the agent or person In charge of said property, by deliver ing a copy of this ordinance to him or such agent in charge, then by posting a copy thereof In a conspicuous place on said property within ten days from the publication hereof and make due return thereof to the city clerk, with the manner of service thereon en dorsed on a copy hereof. And that the said owners thereof shall be there by notified and ordered to build said sidewalks the full length of their re spective abutting property of the ma terlals and dimensions and wltnin the time above specified, and if he shall fail thereof, the city will, by authority in it vested by legislative act of the territory of New Mexico, entitled "An Act to Authorize the Building and Re pair of Sidewalks in Cities, Towns and Villages," proceed to build said side walk, and tax the cost of construction thereof against the property adjoining thereto and the owners of the same. ORDINANCE NO. 326. An Ordinance creating the office of City Scavenger: Be It ordained by the City Council of the City of Albuquerque, New Mex ico: Section 1. The Mayor, by and with the advice r.nd consent of the City Council, shall appoint a City Scaven ger, who shall hold of fic ! until the expiration of the present administra tion, and in the future he shall hold office the same as other City officers; Provided, however, that the City Coun odors therefrom, nor shall any person) move the carcass of any dead animal except it be covered from view during removal. Sec, 9. It shall be unlawful for any person or persons to throw or deposit upon any street, alley or private prem ises within the city, any paper, straw, old clothing, shoes, bottles, dishes, glass ware, or other litter, nor to sweep the Banie upon any street or alley or other place. Nor shall any one engaged in hauling garbage or rubbish of decaying matter of any kind, be permitted to or cause any of the said matter to fall and remain in the streets. Sec. 10. The City Scavenger shall j provide suitable wagons, tool, aim other appliances necessary for the j performance of his duties as herein' prescribed. ' "v - - n bago, liquid refuse, manure, or any other refuse; Provided, that this con dilion does not apply to persons haul ing their own garbage wlih their own teams. See. 11. The City Scavenger may contract fnr the removal of garbage, manure and other substances from pri vate premises to the city dumping ground; but in the absence of a con tract, the City Scavenger shall not be permitted to charge in excess of twenty-five cents for the removal of a barrel, garbage or ash can, nor more than one dollar per wagon load for the removal and destruction of any substance whatever. For the removal and destruction of dead animals the Scavenger may charge not to exceed five dollars for a horse, cow, mule or burro, and not to exceed fifty cents for the removal and destruction of smaller animals. And in removing the contents of cess pools and privy vaults no scavenger shall charge to exceed two dollars per barrel or to exceed ten dollars per load. Sec. 12. Any person, firm or cor poration who violates or falls to com ply with any of the provisions of this ordinance shall be deemed guilty of a misdemeanor, and, on conviction thereof, shall be fined not less than ten dollars nor more than fifty dol lats. And no person shall deposit, or cause to be deposited, any garbage, rubbish, manure, dead animais oi other offensive or unwholesome mat ter at any place other than that des ignated as the city dumping ground. Sec. 4. There shall be, and there are hereby established within the lim its of the City of Albuquerque, two garbage districts, to be known and designated as Garbage District No. 1 and Garbage District No. 2. Garbage District No. 1 shall com prise all that portion of Albuquerque which lies north of Railroad avenue, and Garbage District No. 2 shall com prise all that portion of Albuquerque which lies south of Railroad avenue. Sec. 5. Within the garbage districts described in this Ordinance there suall be provided and kept by the owner,' agent or occupant of any and every building, a suitable covered me tallic vessel, free from leakage, In w hlch shall be placed all garbage and liquid refuse that accumulates in said building or on the premises. Said receptacle shall be emptied not less than once during each week, in spring, summer and fall, but not less than once in two weeks In winter, and in each case oftener if so desired by the Board of Health. Sec. 6. Seven Indictments for land frauds have been returned by the inquisitors. Only six of the in dictments have been made public, as the -men named In the seventh have not yet been arrested. Those Indicted are: B. H. Talimadge Indicted on several counts charged with conspiring to defraud the govern ment by unlawfully obtaining pos session of public lands; C. C. Young, Walter Haynes. John F. McGrew and James W. Overstreet, indicted on the same charge as Talimadge. When arraigned all pleaded, not guilty and were bound over to the next term of court for trial.
