As a remedy against tho alarming in

at will not scruplo to uso corrupt
meaos to accomplish its ends, and con
tinue iisolf iv power,—would bo more
dangerous to our liberties than when con
trolled by private individuals, no mat'ir
how tyrannically or unscrupulously they
might use their influence. But, of course,
it will bo sometime yet, and require a
great deal of agitation, and a very lengthy
discussion of tho merits of this new pro
position, before anything definite can be
arrived at in respect to tho matter. It is
a groat revolution and should not be hastily
entered upon, or without tho most mature
deliberation, if, indeed, the proposition
shall ever bo entertained as either wise or
feasible.
Iv the January number of the North
Americin Review Charles Francis Adams,
who has devoted considerable time and
attention to this matter, and written
several able articles upon the subject, con
tinues, to some extent, his theory that the
General Government ought to assume con
trol of the railroads. He is alarmed at
I consolidation of roads, and intimates
; it will yet be applied to competing aa
1 as connecting lines. He says that
inteen years ago six roads divided tho
to between Albany and Buffalo, and in
8 thrao were consolidated into one.

"This is the tendency of legislation in many
of the Western States, where the result* of
Uorernmcnt meddling are still fresh in tbe
popular memory. Foremost among these
States is Illinois. Id the remarkable constitu
tion just adopted there, tbe great principle is
for the first time recognized tbat the railroad
system is exceptional among all industrial
pursuits, and must be recognized and dealt with
as such. This in itself is an immense stride in J
advance. The ono striking feature of the
Illinois constitution is the strong resolve of its I
fraoiers lo do away with what is known in
England as class legislation. A sound system
of government should recognize individuals no I
more than tbe laws of nature recognize them.
The law should apply to ail, without discrimi
nation for or against."
The chief ends to be attained by State
legislation are reasonable rates of charges
on the different railroads, and prevention
of unjust discrimination, aud extortion in
ithe rates of freight and passenger tariffs.
Mr. Adams, however, decidedly holds
that special tribunals are essential to
achieve these ends, and we close this ar
ticle with quoting his views :
"The Legislature should enact its general
laws for the requirements of railroads, as it
does to meet the innumerable civil and crim
inal complications which arise; but, in the
one case as iv tbe other, the judicial and dis
cretionary action under the general law should
be devolved upon tribuuals specially created
to take cognizance of them. The Legislature
declares the rule which is the same to all ; but
the degrees of discretion which varying; cir- I

must constitute a trnst necessarily delegated to
-tliers. At present all these distinct power* I
ire jealously retained by the Legisla
:ures. Tbeir committees sit as courts
md take evidence aud listen to argu
nents. So far it is well. At this point,

aw or dismissing the individual case,
hey undertake to give a charter to this appli
.tnt and to refuse it to that; to pass a special
,ct in favor of this corporation, and to reject
t as regards tbat; to authorize an increase of
stock here, and to direct the construction of a
new depot there. These are functions which
no legislative body can successfully perform;
as well undertake to decide every suit at law,
or to affix tbe penalty lo every crime. Just
so long as Legislatures insist on themselves
doing work of tbis nature, just so long will
corruption increase and the statute book fall
into confusion.
"This tribunals should be clothed with all
necessary powers, and be put forward as if the
members were fully competent to represent the
interests of th.'State-, with an experience and
ability, a knowledge ot details and a zeal in
their occuj.aii'iii equal to that ever so con
spicuously displayed by the events of the cor
poration*. Such men could certainly be found;
the corporations always have them. Mean
while the whole subject may be summed up in
a few words: (."rider a *y*t*lß which permits
special legislation, Board* for the regulation
of railroads are useless; they are, however,
indijpensable under tine yvhich confine* itself
to general law*.
