SHE CAN'T BE KILLED.
Tillie Hubert in Three Real
Life Tragedies.
Three of Her Lovers Have Killed
Themselves.
The Victim of Lauzier's Bullets Will Re
cover—She Was Once a Famous
Circus Rider—Her Lovers Are
Prone to Suicide.
Yesterday morning Drs. Choate and
McCarty extracted the bullet which
was imbedded in the back of Tillie
Hubert's head by Lauzier on Saturday
morning last, and her recovery is now
assured.
The other bullet which was supposed
to have entered the tissues of her
throat, was found on the floor in her
room, never having pierced her body at
all. It struck the wall, and on acconnt
of the mark it left there, it was at first
believed that Lauzier had fired four
shots, instead of three, but it is now
positively known that Mrs. Hubert was
only shot once, and as the wound is en
tirely of a superficial nature, she will be
on her feet in less than three weeks.
A Herald reporter yesterday saw
Tillie Hubert in the room where the
shooting occurred on Commercial street.
She was propped up on a couple of pil
lows and talked about the affair. She
said: "Lauzier was standing at the
door and 1 was within two feet of him
when be fired the first ahot. The blood
from the wound spurted all over Lau
zier. I said: 'For God's sake do not kill
me,' and struggled with him to get the
gun which he had in bis right hand
which he kept behind his back. I
was not successful in getting the gun,
and he fired a second shot, at the same
time saying: 'Hannah, we will die to
gether!' He then ahot himself."
From what could be ascertained the
Hubert woman, known here as Lillie
Bailey, has had a varied career and
bears a charmed life against bullets.
She ia a French-Canadian, and when 15
years old ran away from home to be
come a circus rider. She made her
debut as a bareback rider in Philadel
phia. What her circus name was the
reporter was unable to find out. At all
events, she was a star equestrienne and
did a sensational act with her brother
in which they rode a number of horses.
The brother was killed while doing bis
act one night.
The Hubert woman continued as a
circus rider until she was 21 or 22 years
old* when she married. She came to
California with Sells Bros, circus and
has lived in a number of cities in the
west.
This is not the first attempt that has
been made to take her life. In Chicago
a jealous lover shot at her, but his aim
was unsteady, and recently in Seattle
a man who became infatuated with her
blew out his brains. So Lauzier'a is
the third tragedy in which she has par
ticipated.
On the woman's bureau is a picture
of herself in tights aa she appeared
when a circus rider. She was a woman
of splendid proportions, but apparently
became too stout to continue in the
calling, since which time she has been
an adventuress.
"They cannot kill me," she said; and
a smile illuminated- her face as she
doubtless thought of her miraculous es
cape the other morning.
"I bear a charmed life." She then
related about her previous narrow es
capes.

Peculiar Developments Yesterday in the
Tapia Bape Case—An Old Inhab
itant Gives His Evidence.
Yesterday the defense opened in the
case of Diego Tapis, who is charged
with committing rape on the person of
Maria de Los Angeles de Soto, at a camp
near Newhall. The case is on trial be
fore Judge Williams in department six
of the superior court.
Macedonio Soto, one of the oldest in
habitants was put on the stand. He
testified to having heard talking over in
Diego Tapia's camp where Miguel and
Maria De Soto were stopping, and cays
the parties had a demijohn of liquor.
"About 2 o'clock in the morning Miguel
and Maria came over to his camp and
asked it they could stop there for the
rest of the night. They did not seen? to
be excited. At that time Macania Ta
pia was Bleeping with me. They were
perfectly cool, and I told them they
could sleep on the floor. They laid
down and snored all night. The next
morning we all went over to the camp of
Diego, and packed up the clothes of
Mr. and Mrs. De Soto. They were
pleasant toward Diego Tapia, and he
held the mustang while we loaded him.
When they went away they bade Diego
good-bye. There did not seem to be
anything wrong, and they exchanged
salutations with Tripia in a pleasant
manner.
"When we went over to see Diego
after breakfast he waß lying down and
very thirsty. What do you call it after
a man has been full, Mr. Stephens?"
asked the witness.
"Well, I give it up," said the attor
ney. "Perbapß the jury can tell."
"Diego was dry and thirsty," contin
ued the witness; "and when he got up
he said good morning to Miguel and
Maria, and then we packed up their
things, and after Baying good-bye they
rode away. There did not appear
to be any trouble Ibetween the parties
then."
The witness was closely cross-exam
ined by counsel for the prosecution, but
nothing.further was developed. The
case will consume the remainder of the
week.

Today's Calendar.
Charles Pinard entered a plea of not
guilty on a charge of felony before Judge
Smith yesterday. The case is set for
trial June 20th.
Judge Van Dyke yesterday, in the
Hyland divorce caße, decreed that the
plaintiff should pay $25 per month ali
mony during the trial and $50 attorney's
fees.
Judgment for the plaintiff as prayed
for was given by Judge Van Dyke in the
suit of J. De Arnaz vs. J. Jaynes et al.
yesterday.
Frederick T. Hayes, a native of Eng
land, was naturalized by Judge Van
Dyke yesterday.
Tbe suit of the Los Angeles Farming
and Milling company vs. Hoff et al. is
still on trial before Judge Van Dyke. J.
E. Jackson was examined yesterday.
The case of J. F. Adams vs. David
Burbank, before Judge Williams, was
continued until May 16th.
The action of the people vs. Wm. Hen
derson was continued yesterday until
May 13th.
A sale of real estate was confirmed by
Judge Clark yesterday in the estate of
Clifford Evans.

PURSUANT TO A RESOLUTION OF THE
board of directors of Modesto Irrigation
district, duly given and made 011 the 4th day of
May, A. 1). 1892.
Notice is hereby given that said board of di
rectors will sell to the his host and best bidder
the bonds of said Irrigation district to the
amount of $250,000, bearing Interest at the
rate of 0 per cent per annum, payable semi
annually, on the Ist dsy of January and July
of each year ou the presentation of the interest
coupons at the office of the treasuicr of said"
district.
Said bonds arc issued by the board of direct
ors of Modesto Irrigation district, in accord
ance with, and by the authority of, an act of
the legislature oj the state of California, enti
tled "An Act to provide for the organization and
government of irrigation districts and to pro
vide for the acquisition of water and other
property, and for the distribution of water
thereby for Irrigation purposes," approved
March 7,1887.
Said bonds will be sold for cash, and for not
less than 90 per centum of the face value
thereof.
Sealed proposals and bids for the purchase of
said bonds will be received by the said beard
of directors at their office in the city of Mo
desto, county of Stanislaus, state of California,
and may be addressed to or left with C. 8.
Abbott, the secretary of said board, at Modesto,
Cal., at any time after the date of this notice,
and until 2:30 o'clock p. m. on the 7th day of
June, A. D. 1892, at which time and place the
said sale will He made.
Said bonds will bo each of the denomination
of $500, aud will be negotiable in form and
will conform in all respects to the requirements
of said act.
The board of directors reserve the right to
roject any or all bids.
