general election will be held through

State, and make careful examinations of

pended, and report the result of his exam
inations to the Governor, to the Legislature,
and to any other officer, or board of officers,
that the Legislature may direct; provided,
that in case the office of Lieutenant-Gover
nor becoming vacant, or in the case of the
functions of Governor devolving upon him,
the President pro tern. of the Senate, or his
successor, shall perform the duties and re
ceive the emoluments of said Lieutenant-
Governor, during the term of such vacancy,
for the time be Is performing such functions
of Governor. The Legislature may by law
prescribe the time and manner that such
examination shall be made. If, during a
vacancy in the office of Governor, the Lieu
tenant-Governor shall be impeacned, dis

Secretary of State, Controller, Treasurer,

at stated times, during their continuance In
office, receive for their services a compensa
tion, which shall not be Increased nor di
minished during the term, which compen
sation is hereby fixed for the following

annum: the Attorney-General, three thou

The Legislature may. in its discretion,
abolish the office of Surveyor-General, and
none of the ofticers hereinbefore named
shall receive for their own use any fees or
perquisites for the performance of any offi
cial duty.
Amendment Number Four (Assembly Con
stitutional Amendment No. s)—
ART. IV, Sec. 34. No bill making an appro
priation for money, except the general ap
propriation bill, and the deficiency MIL for
the appropriation of money exclusively de
voted to the support of the General Govern
ment and State institutions, shall contain
more than one appropriation, and that for a
single and certain purpose to be therein ex
pressed. When the deficiency bill Is pre
sented to the Governor, he may object to
one or more items, while approving other
portions of the bill. No officer of the State
shall have power to Incur any deficiency ex
cept in case of actual necessity, and then
only upon the written authority, first ob
tained, of the Governor, Secretary of State
and Attorney-General. Any deficiency in
curred ln violation of this provision shall be
void, and the Legislature shall not have the
power to appropriate money to pay the
same.
Amendment Number Five (Senate Consti
tutional Amendment No. 14)—
Art. XI, Sec. 8. Any city containing apop
ulation of more than three thousand five
hundred Inhabitants may frame a charter
for Its own government, consistent with
and subject to the Constitution and laws of
this State, by causing a Board of fifteen
Freeholder*, who shall have been for at
least five years qualified electors thereof, to
be elected by the qualified voters of said
city at any generalorspeclalelection,whose
duty it shall be. within ninety days after
auch election, to prepare »nd propose a
charter for said city, which shall be signed
ln duplicate, by the membtrs of such board,
or a majority of them, aad returned, one
copy to the Mayor thereof, or other chief
executive officer of such city, and the other
to the Recorder of the county. Such pro-
Soned charter shall then be published in two >
ally newspapers of general circulation ln
such city for at least twenty day*, and the
first publication shall be made within twenty •
days after the completion ot the charter:
provided, that in cities containing a popula
tion of not more than ten thousand inhabi
tants such proposed charter shall be pub
lished in one such dally newspaper; and
within not less than thirty days after such
publication it shall be submitted to the quad- i
lfled electors of satd city at a geueral or
special election, and if a majority of such <
qualified electors voting thereat shall ratify
tne same.it shall thereafter be submitted to
the Legislature for lis approval or rejection i
as a whole, without power of alteration or
amendment. Such approval may be made
by concurrent resolution, and if approved
by a majority vote dT the members elected
to each house. It shall become the charterof
such city, or If such city be consolidated i
with a county, then of such clt7 and county,
and shall become the organic law thereof,
and supersede any existing charter and all <
amendments thereof, and all laws lnconslst- 1
ent with such charter. A copy of such char- i
ter, certified by the Mayor, or chief execu
tive officer, and authenticated by the seal of »
such city, setting forth the submission ot
such charter to tne electors, and its ratlflca- ■
tion by them, shall, after the approval of
such charter by the Legislature, be made, •
in duplicate, and deposited, one ln the office
of the Secretary of State, and the other, i
after being recorded in said Recorder's of
fice, shall be deposited in the archives of the
city, and thereafter all courts shall take Ju- i
dlclal notice of said charter. The charter,
so ratified, may be amended at Intervals of
not less than two years by proposals there
for, submitted by the legislative authority of
the city to the qualified electors thereof, at
a general or special election, held at least
forty days after the publlcatlrn of such pro
posals for twenty days in a daily newspaper >
of general circulation in auch city, and rati
fied by at least three-fifths of the qualified
electors voting thereat, and approved by the
Legislature, as herein provided for the ap
proval of the charter. In submitting any
such charter, or amendments thereto, any
alternative article or proposition may be
presented for the choice of the voters, and
may be voted on separately without preju
dice to others. ,

arately from the others, by ballot, at the
next general election, to be held on Tues
day, the eighth day of November, A. D. 1802.

bonds to create a fund for the construction and
furnishing by the Board of State Harbor Com
missioners of a general jerry and passenger j
depot in the City and County of San Francisco;
to create a sinking fund for the payment of said
bonds, and providing for the submission of this r

The People of the State of California, represented in c

Section L For the purpose of providing !
a fund for the payment or the Indebtedness *
hereby authorized to be incurred by the 3
Board of State Harbor Commissioners, for N
the erection and furnishing of a general 3
railroad, passenger, and ferry depot, at or (
near the foot of Market street, in the city c
and county of San Francisco, at a cost not 1
to exceed six hundred thousand dollars, '
which the said Board of State Harbor Com- tj
mlssioners arc hereby authorized to con
struct in the manner and method author- '
ized by law, and at a cost not to exceed said J
six hundred thousand dollars, the State J
Treasurer shall, immediately after the Is- J
suance of the proclamation 01 the Governor, '
hereinafter provided for, prepare suitable £
bonds of the State of California: one thou
sand bonds, in tbe denomination of one hun- °-
dred dollars each; five hundred bonds, ln J
the denomination of five hundred dollars '
each; two hundred and fifty bonds, ln the 1
denomination of one thousand dollars each. •
The whole issue ot said bonds shall not ex- J
ceed the sum of six hundred thousand dol- «
lars, which said bonds shall bear interest at 1
the rate of four percentum per annum from '
their date, and snail be pay aide at the office
of the State Treasurer at the expiration ot '
nineteen years from their date. Said bonds
shall bear date the first day of January, A.
D. eighteen hundred and ninety-three, and "
shall De payable on the first day of January, '
A. D. nineteen hundred and twelve. The in
terest accruing on said bonds shall be due
and payable at the office of the said Treasu- 3
rer on the first day of January and the first \
day of July of each year; provided, that the I
firstpaymentof interest shall be made onthe '
first day of July, A. D. eighteen hundred and \
ninety-three, on so many of said bonds as
have been theretofore Issued. Attheexpi- 1

same out of the San Francisco Depot Sink- •

Act. Said bonds shall be signed by the Gov- 1

Sec. 2. Interest coupons shall be attached 1
to each bond, so that they may be removed ;
without Injury or mutilation to the bond. 8
Said coupons, consecutively numbered, shall '

Interest on any of said bonds shall be paid 1
for any time which may Intervene between •
the date of any of said bonds and the issue '
thereof to a purchaser. 1

Sec. 4. When the bonds authorized to be 1
issued under this act shall be duly executed,
numbered consecutively, and sealed, they :
shall be by the State Treasurer sold at J
public auction to the highest bidder for >
cash, and in such parcels as said Treasurer J
shall deem best; but he must reject any and -
all bids for said bonds, or any of them,
which shall be below the par value of satd 1
bonds; and he may by public announcement <
at the place of sale, continue such sale, as to t
the whole or any part thereof, to any time 1
and place he may select. Due notice of the <
place and time of sale of such bonds shall be t
fiven by said Treasurer by publication ln :
wo newspapers published in the city and t
county or San Francisco, and also in two f
newspapers published in the city of Oak- i
land, two published ln the city of Los An- 1
geles, and two published ln the city of Sac- <
ramento, once a week for four weeks prior <
to such sale. The cost of such publication 1
shall be paid out of the San Francisco Har- :
bor Improvement Fund, on Controller's 1
warrants duly drawn for that purpose. The t
proceeds of the sale of such bonds shall be 1
forthwith paid over by said Treasurer into <
the treasury, and must be by him kept ln a 1
separate fund, to be known and designated 1
as tbe "San Francisco Depot Fund," and
must be used exclusively for the building :
and furnishing of said depot. Drafts and 1
waxrants upon said fund shall be drawn 1
upon and shall be paid out of aaid fund 14

Francisco Harbor Improvement Fund.
DSsc. 5. For the payment of the principal
and Interest of said bonds a sinking fund, to
be known and designated as the -'San Fran
cisco Depot Sinking Fund," shall be and the
same is hereby created, as follows: The
State Treasurer shall, on the first day of
each and every month after the date of said
bonds, take from ths San Francisco Harbor
Improvement Fund the sum of four thou
sand six hundred and thirty-one dollars and
pl a <;e the same in said San Francisco Depot
s.nklng Fund, created by this section. Said
treasurer slnll, on Controller's warrants
duly drawn for that purpose, employ the
money in said Sinking Fund tn the pur
chase of bonds of the United States, which
said bonds shall be kept ln a proper
receptacle, appropriately labeled; but he
must keep always on haad a sufficient
amount of money in said sinking fund with
which to pay the interest on the State bonds
herein provided to be issued. And to pro
vide means for the payment of said sum of
live thousand one hundred and thirty-one
dollars, monthly, from said San Francisco
Harbor Improvement Fund into said San
!• r licisco Depot sinking Fund, and for the
other payments out of said fund authorized
by this Act, and as provided for therein, the
said Board of State Harbor Commissioner*
are hereby authorized and directed, by the
collection of dockage, wharfage, tolls, rents
and cranage, to collect a sum of money suffl*
elent therefor, over and above the amount
limited by section two thousand five hun
dred and twenty-six of the Political Code of
the State of California After the payment
of all said bonds the surplus or balance re
maining ln said sinking fund, tf any there
be, shall forwith be paid into the San Fran
cisco Harbor Improvement fund. At the
maturity of satd State bonds the said Treas
urer shall sell the United States bonds then
ln said sinking fund, at governing market
rates, and place the proceeds in said San
Francisco Depot Sinking Fund, and shall
pay out the same ln extinguishment of aaid
State bonds, on Controller a warrants truly
drawn tor that purpose.
S«o. «. The State Treasurer shall keep
full and particular account and record of all
his proceedings under this Act. and he shall
transmit to the Governor an abstract of all
his proceedings thereunder, with his annual
report, to be by the Governor laid before
the Legislature; and all books and papers
pertaining to the matter provided for la
this Act shall at all times be open to the In
spection of any party Interested, or the Gov
ernor, or Attorney-General, or a committee
ofellh.-r branch of the Legislature, or a
Joint committee of both.
Sag. 7. It shall be the duty of tne State
Treasurer to pay the interest on said bonds
when the same falls due, out of the sinking
fund provided for In this Act, on Control
ler's warrants duly drawn for that purpose.
BUG 8. This Act, if adopted by the people,
as hereinafter provided for, shall take ef
fect on the thirty-first day of December, A.
D. eighteen hundred and ninety-two, as to all
its provisions, except those relating to and
necessary for its submission to the people,
and for returning, canvassing and proclaim
ing tbe voles, and as to such excepted
provisions this Act shall take effect immedi
ately.
Sua 9. This Act shall be submitted to the
people of the State of California for their
ratification at the next general election to
hi-hidden In the mouth ot November, A.D.
eighteen hundred and ninety-two; and the
qualified electors of the State shall, at said
election, on their ballots, vote for or against
this Act; those voting for the same shall
write or have printed on their ballots the
words ' For the San Francisco Depot Act,"
and those voting against the same shall
write or have printed on their ballots the
words "Against the San Francisco Depot
Act." The Governor of this State-shall In
clude the submission of this Act to the peo
ple as aforesaid in his proclamation calling
for said general election.
Sec. UK Tne votes cast for or against this
Act shall be counted, returned and can
vassed, and declared in the same manner
and subject to the same rcles as votes cast
for State officers: and If it appear that said
Act shall have received a majority of all

pealable until the principal and Interest of
the liabilities herein created shall be paid
and discharged, and the Governor si all
make proclamation thereof; but if a major
ity of the votes cast as aforesaid are agal.ist
this Act, then the same sha'.l be an d become f
void.
Baa 11. It shall be the duty of the Secre
tary of State to have this Act published ln
at least one newspaper ln each county, or
city and county. If one be published therein,
throughout this State, for three months
next preceding the general election to be
holden ln the month of November, A. D.,
eighteen hundred and ninety-two. Tne
costs of such publication shall be : aid out of
the' General Fund, on Controller's warrants
duly drawn for that purpose.
Sec. 12. This Act may be known ai d cited
as the "San Francisco Depot Act."
Sec. 13. All Acts or parts of Acts ln con
flict with the provisions of this Act are
hereby repealed.
Third—
Ah act to ascertain and cruras the will of the peo
ple of the State of California'upon the subject of
requiring an educational qualification of voters.
Wheheas, It is expedient that the wishes
of the people of this State upon tbe suo
jectof requiring an educational qualifica
tion of voters should be unmistakably ex
pressed, ln order that future Legislatures
may be guided thereby ln submitting
amendments to the Constitution of the
State; therefore,
The people of the Sate of California, represented in
Senate and Assembly, do enact as follows:
Section 1. That thirty days prior to the
next general State election the Governor
shall issue his proclamation calling '», « m the
electors to signify at said election tl/eir will
as to whether an educational qualification
should be required of voters ln this State,
by placing upon the ballots the words "For
an educational qualification requiring every
voter to be able to write his name aud read
any section of the Constitution ln the En
glish language," or the words "Against an
educational qualification requiring every
voter to be able to write his name and read
any section of the Constitution ln the En
fllsh language:" and tbe Inspectors and
udges of Election at each and every poll ln
the State shall ascertain and make returns
of the number of votes cast "For an educa
tional qualification requiring every voter to
be able to write his name and read any sec
tion of the Constitution ln the English lan
geage," and the number of votes cast
"Against an educational qualification re
quiring every voter to be able to write his
name and read any section of the Csnstltu
tlon ln the English language." in like man
ner as other votes are required to be counted
and returned; and an abstract thereof shall
be transmitted by each County Clerk in the
State to the Secretary of State, in the same
manner that votes for State officers are now
required to be transmitted.
Fourth—
An act to provide for the payment of funded
indebtedness of the State of California and
to contract a funded debt forthat purpose.
The people of the State of California, repre
sented in Senate and Assembly, do enact
as follows:
Section 1. For the purpose of liquidating
and providing for the payment of the funded
Indebtedness of the State of California
hereinafter specified, and to lessen the bur
den of taxation, the Governor of the State,
the Controller of State and Treasurer of
State and their successors in office shall
constitute a Board of Commissioners, to be
styled the Loan Commissioners of the State
of California, and shall have and exercise
the powers and perform the duties herein
after provided.
Sec. 2. The said Loan Commissioners are
hereby authorized to issue and sell not ex
ceeding two million five hundred and
twenty-eight thousand five hundred dollars
($2,528,500) of the bonds of said State, bear
ing interest at the rate of four per cent, per
annum, which Interest shall be payable
semi-annually, ln gold coin, on the second
days in April and October ln each year at
the office of the Treasurer of State. The
principal of said bonds shall be made pay
able in gold coin within twenty years after
the date of their Issue, and shall be of such
denominations as tbe said Loan Commis
sioners shall direct, but not less than five
hundred dollars; shall bear the date
of their issue, and shall be signed
by the said Loan Commissioners, and shall
have the seal of the State affixed thereto;
and the faith of the State of California is
hereby pledged for the payment of said
bonds and the Interest accruing thereon, as
hereinprovlded.
Sec. 3. Coupons for the Interest shall be
attached to each bond, so that they may be
removed without Injury or mutilation to
the bnnds; said coupons, consecutively num
bered, shall be signed by the Treasurer of
State.
Sec. 4. Before the sale of any of said
bonds the said Loan Commissioners shall
cause notice of such sale to be published for
the space of one month ln two dally news
papers, published ln English, one ln the
city of San Francisco and one In the capital
of the State. Such notice shall specify the
amount of bonds to be sold, the rate of in
terest they shall bear, the date and hour of.
sale, the place of sale, which shall be at the
State Capitol, and that sealed proposals will
be received by the said Loan Commission
ers for the purchase of said bonds, within
one month from the expiration of such pub
lication: and on the day and hour named in
said notice, the said Loan Commissioners
shall open all sealed proi oials received by
them, and shall award the purchase of said
bonds to such bidders as will, ln their
opinion, make the most advantageous bid
for the State; provided, that said Loan Com
missioners may reject any or all bids it
they deem it to the advantage of the Statei
